三方协议英文版TheEmploymentAgreementforthegraduatesinShanghaiNo.8016879EnterpriseNameEnterpriseNatureTelephoneNo.AddressPostNo.OrganizationCodeRegistrationNo.EnterpriseNamePostNo.PartyAArchivesAcceptanceAddressNameSourceAreaUniversityNameEducationalQualificationSpecialtyGraduationTimeTelephoneNo.PartyBIDNo.StudentNo.ThisAgreementismadebyandbetweenPartyAandPartyB.Thedetailsareasfollows:Article1(Agreementsubject)PartyAhasintroducedtheinformationoftheenterpriseandjobtoPartyBandagreedtohirePartyBaftertheacquaintanceandevaluationwithPartyB.PartyBhasintroducedtheinformationofhimself/herselftoPartyAandagreedtoworkforPartyAandtoregisterontheprescribedperiodaftertheacquaintancewithPartyA.Article2(Theappointmentsofrelevanttermsinlaborcontract)(Remarks:Thisarticleshouldbespecificandbothsidescanmakeanattachedappointmentifnecessary)1.Thefirsttermoflaborcontractis_______years(amongwhich,theworkperiodis_______years)andtheprobationperiodis_______months,whichbeginsonthedatePartyBregistersattheenterprise.2.TheworkingconditionandlaborprotectionofferedbyPartyAtoPartyBshouldconformtothecountry’srelativerequirements.3.PartyAoffersPartyBthesocialsecuritiesaccordingtothecountry’srequirements,i.e.endowmentinsurance,hospitalizationinsurance,unemployedinsurance,etc.,thehousingfundandotherbenefits,i.e.__________________.4.Afterdeductedthesocialsecuritiesandbenefitsmentionedabove,thesalaryofPartyBis_______RMB/month.Article3(Thecancellationoftheagreement)PartyAcancancelthisagreementandwillundertakenodefaultresponsibilityifPartyBhasanyoneofthefollowingsituations:1.PartyBhasnotthegraduationqualificationordoesnotreachthehealthstandardfortheemploymentaccordingtothecountry’srequirementswhenPartyBmakestheregistrationattheenterprise;2.Thecontentsin“theRecommendationFormForGraduates'JobApplication”aretotallyfalsely;3.TheapplicationoftheShanghairesidentpermitisnotapproved,ifthesourceareaofPartyBisnotShanghai;4.Othersituationsaccordingtothecountry’sregulationsandlaws.PartyBcancancelthisagreementandwillundertakenodefaultresponsibilityifPartyAhasanyoneofthefollowingsituations:1.Thelaborprotectionandhealthconditionsaresobadthattheemployee’spersonnelsafetyandhealthareseriouslythreatened,whichisconfirmedbythelaborandsanitationdepartments;2.PartyAdoesnotabidebythisagreementandinfringesthelegitimaterightsofPartyB;3.Theenterpriseiscancelledordeclaresbankrupt;4.PartyAdoesnotwillingtotransactthelaborandemploymentproceduresforPartyB;5.Othersituationsaccordingtothecountry’sregulationsandlaws.Article4(Defaultresponsibility)BothPartyAandPartyBshouldfulfillthisagreementcompletely.Anysidethatcancelsthisagreementimproperlyorviolatestheappointmentsofthisagreementshouldundertakedefaultresponsibilityandpaythepenalty_______RMBtotheotherside(Remarks:thepenaltyissuggestednottobehigherthanthemonthsalaryofPartyBmentionedintheArticle2)Article5(Supplementaryclause)Inthecasesofthenationalneeds,enrollment(studyabroad),etc.,thatPartyBcouldnotfulfillthisagreement,theapplicationmethodreachedbyPartyAandPartyBisasfollows:Article6(Thevalidationoftheagreement)ThisagreementgoesintoeffectfromthedateofsignaturesofbothPartyAandPartyB.ThisagreementshouldbesenttothePartyB’suniversitybyPartyA(orPartyB)tomakearegistrationin10daysafterthesignaturesofbothsides.Thisagreementshouldbelistedtotheemploymentprogramsaftertheregistrationattheuniversity.Article7(Theterminationoftheagreement)AfterPartyBregistersattheenterprise,bothsidesshouldsignthelaborcontract(employmentcontract)intime(atmostnotmorethanonemonth)accordingtotherelativelawsandthearticlesofthisagreementandtransacttherelativerecruitmentprocedures.Thisagreementisterminatedafterthelaborcontract(employmentcontract)issighed.Article8(Thedocumentoftheagreement)ThisagreementismadeinfourcopiesthateachofPartyA,PartyBandtheuniversityholdsoneandthefourthcopyshouldbesafelykeptbyPartyAorPartyBinthecaseoftransactingtherelativeprocedures.PartyA(Theemployer):Operator(Officialstamp):Date:Authenticator:TheUniversitynameDepartment:Operator:Address:Date:PartyB(TheGraduate):Signature:Date:(Stamp)TelephoneNo.:
