试论罪犯脱逃的原因及防范对策 3 关于罪犯脱逃的原因及预防措施的调查 调查人: 包林涛 辅导老师:张要平 调查时间:2013年2月-2013年3月 调查地点:农二师库尔勒监狱 调查:在监狱实习，通过案例，向民警了解 总结 调查内容:罪犯脱逃的原因及预防措施 1 关于罪犯脱逃的原因及预防措施的调查报告 ——包林涛 罪犯脱逃是指依法被关押的罪犯，逃脱监狱机关的关押，和监管的行为。在我国罪犯脱逃严重威胁着监管安全，改造秩序和社会安定，是监管安全工作的重中之重，历来为监狱机关高度重视。我国每年都有大量不同类型的犯罪行为发生，因此羁押大量不同类型的罪犯，被判刑入狱接受改造，其中总有个别犯罪分子，不愿认罪伏法，安心改造，而是想法设法逃出监狱。罪犯脱逃的发生不但严重破坏了监管改造场所的稳定更严重的是给社会带来了更多不安定和威胁因此防止罪犯脱胎是监狱改造工作根本任务。 针对目前监狱当中，罪犯脱逃的情况比较严峻，而脱逃的发生必然会引起人民群众的生命财产安全，带来的威胁也会造成社会的不安定因素的增加，从目前罪犯脱逃的原因及特点出发。更好的维护社会的安定和人民的生命财产安全，为找出更好的预防预防罪犯脱逃的方法和措施，我来到农二师库尔勒监狱，针对近10年，全国12起脱逃案件，进行查阅分析，走访了2所监狱，向18位民警了解，找出一系列关于罪犯脱逃的方法和规律希望能对监管秩序稳定和社会安定起到一些积极作用，更好的财产，促进罪犯更好的改造。 一、罪犯脱逃的成因分析 (一)罪犯脱逃的主观因素 (1)、不认罪，不服判导致抵触改造，产生报复欲望 刚刚入狱的罪犯，往往是因为习惯了在社会中横行霸道，骄奢淫 2 逸的奢华生活。抱有侥幸心理，如不认罪、不服法，认为自己是冤枉的，认为自己是“错判、误判”所受到的“不公正待遇”心怀怨恨，尤其是一些心胸狭窄的罪犯，认为自己之所以身陷囹圄，完全就是因为揭发人、检举人、办案人，、偏狭地认为如果没有这些人，自己就不会落得这样的下场，宁可玉碎不让瓦全。侥幸为自己的事平反。若能出狱，一定要报复。平反不了，边滋生逃脱哪怕只为报复，也要逃出去。 (2)原有犯罪心理的延续与现实中的严格管理发生冲突 多数罪犯在判刑之前，都有较长的劣迹。早已养成了好逸恶劳、放荡不羁的恶习，他们游手好闲、无恶不作，有些人靠犯罪获得的收入，维持着腐化奢靡的生活，但入监狱后，他们原有的生活方式与监狱的严格管束、生活、强制劳动改造与原先大墙中外的的生活之间形成强烈的反差，心理上、生理上发生了极大的不适应，渴望回到过去“重操旧业”。走出牢笼，急切逃离监狱恢复过去的生活。就会萌发----脱逃。 (3)、改造信心不足，对出狱后未来绝望悲观 这是多起预谋脱逃罪犯的共同的特点:改造信心不足，对前途悲观失望。(民警对新入监的罪犯的心想态度教育，树立正面希望的信心) 有些对入狱服刑的观念较为守旧，认为社会鄙视服过刑的罪犯 认为刑满出狱后也是无用之人;特别是有的年轻的长刑期犯，认为他们人生的黄金时期都将在监狱度过，感到将来生活无望;有些年长的 3 罪犯因身患疾病，担心会死在监狱;即使将来回归社会之时自己没有一技之长，又无亲人远去，妻离子散，自己给自己打上犯罪人的标记无法立足与社会与其荒渡余生不如孤注一掷，听天由命，要么逃出去，要么死在这里，在绝望中，逃避现实。 (4)、对劳动改造的不适应，逃避惩罚 我国《监狱法》明确规定，凡有劳动能力的罪犯必须参加劳动。履行劳动是每个罪犯应尽的义务，有的罪犯因主观恶习较深，入监后对过去的犯罪生活总是留恋、伺机逃跑出去重新作案，重新过上“自由幸福”的生活，因在社会上过惯了寄生生活，入狱后非常惧怕劳动,在日常的劳动改造中，由于不思进取，或体能不佳，跟不上集体劳作的流水速度，耽误了生产，影响其他罪犯的改造成绩而受到他犯的指责和排斥，当他们采用各种办法仍然无法改变劳动现状时，面对无法回避的强制性劳动，就企图改换环境，希望借脱逃来解脱 。 (二)罪犯脱逃的客观原因 对于罪犯脱逃的客观原因我首先从我们监狱民警的主观意识及行为探讨起: (1)、警察的麻痹大意。 随着我们监管工作日趋具体化，复杂化，有的监狱，监管体系信息技术和人性化尚未建立健全。这要引起我们全体监狱人民警察的足够重视。若我们在工作中出现狱情不明、耳目不灵、管理和教育缺乏针对性，就会为罪犯脱逃提供了可乘之机。监狱警察长期与罪犯打交道，在“朝夕相处”的过程中，监狱警察虽然占主导地位， 4 但时间一长总认为罪犯也是有血有肉有感情的人，认为他们是困在笼子里的老虎伤不了人～不会也不敢重新犯罪，过份信任和依赖他们，放松了应有的警惕，失去了应有的戒备，被穷凶极恶的罪犯所利用～ (2)、监控系统和报警系统落后，且警力不足。 我国监狱系统在不同程度上存在视频监控系统和报警系统不完善的问题，监狱的信息化建设仍然比较落后，警力不足及警力分布结构的不合理性，一线警察的工作任务重、压力大、风险高，一旦出现安全事故，轻则行政处分，重则刑事处分。而他们的相应待遇和福利却没有得到重视，有时候由于没完成好生产任务，工资还要下浮，骇人听闻的“10、17”罪犯脱逃事件。这血的教训，同时也暴漏出我们监狱的视频监控;报警系统的不完善等等～ (3)、民警善意的主动权 罪犯被封闭的状态，让我们民警应主动关心其身理，心理及家庭。 罪犯也是人，与正常人一样有七情六欲，一样会思乡念亲。若想让罪犯认罪伏法，安心改造，民警应占据主动权，关心你“那片责任田”工作重心在人，关心罪犯的思想动态，身体状况。以及他们家热发生重大变故，如家庭与其断绝关系、妻子与其闹离婚、亲人生重病或死亡、家人被欺负等等，帮助解决他们的实际困难，促其安心改造，放弃脱逃的念头。 二、罪犯脱逃基本规律及表现 罪犯的脱逃由思想的构成，实施行为其表现是可知的，若你是一位负责人的民警你一定会觉察到的～没有理由;没有借口! 5 (一)行为的反常性为实施脱逃作积极准备 罪犯若要脱逃心理形成和发展的过程中，总有一定的外部表现。这些行为表现有助于及时发现罪犯脱逃。尽管每个欲脱逃罪犯可能因脱逃动机、方式及自身个性特点和经历的不同，其脱逃行为表现存有一定的差异性。但脱逃罪犯在脱逃前为实施脱逃作积极准备时，其行为必然有所反常。 (1)、脱逃罪犯经常纠合在一起。 (2)、过分关注民警的活动规律，活动场所，习惯;程序;在时间地点中找漏洞。 (3)、在同一时间段不是同一工种、不在同一小组劳作的多个罪犯，利用时机聚集在一起。 (4)、出逃前表现现异常积极，这就应该引起值班民警的高度警觉。 为脱逃准备资金、衣物及作案工具; (5)、注意观察地形和警戒措施，了解周围驻地的交通情况，为顺利实施脱逃寻求最佳途径; (6)、观察并打听民警的值班时间，选择自认为最恰当的脱逃时机。 (二)、罪犯认为脱逃的“天时，地利;人和” 时间的选择对于准备脱逃的罪犯是非常关键的一步。一万套脱逃计划也顶不上实施的一步，罪犯在脱逃的季节选择上一般集中在夏秋 6 两季 因为这个季节气候宜人，植被茂盛，容易隐藏，便于野外生存。在脱逃的具体时间上大多数选择节假日警力较薄弱的时段。甚至还利用意外事件，如捕捉天气状况，在下大雾、大雨、大雪等奇寒天气时，罪犯脱逃率明显增加;或者监狱发生民警或罪犯的意外事故，现场混乱时，罪犯就很可能趁乱出逃----天时:地利;人和～ 综上所述，我总结出虽然罪犯脱逃心理产生的过程是秘密而隐蔽地进行的，但罪犯从产生脱逃心理到脱逃的整个过程中，总会露出一丝蛛丝马迹。因为，人的心理是脑的机能，是外部世界的反映。欲要脱逃，必有先兆。这一基本规律只要监狱民警注意并善于观察、善于分析，罪犯要脱逃的行迹是不难发现的。 三、罪犯脱逃的防范对策 (1)、基础构建长效机制，从日常管理着手 。 坚守在队伍最前面的的是一线民警，与罪犯长相厮守的日常管理制，不放过每一个细节，不缺补人物技每一个漏洞，无论是民警还是罪犯，都不给任何犯错的可趁之机。监管安全要时时抓，日日会;月月总年年奖!民警占据主动调节融入互动～ (2)、对于罪犯的衣食住行要 ;观察 记录 关心重点时期，重点时段;重点防范，重大节日，重点岗位，掌握清晰～ (3)、耳目建设，狱情收集，要严格把关做到及时保真，保密。建立运之有效的奖惩措施。 (4)、要从物防技防下手，及时检索不再让犯罪有可乘之机。加 7 强设施建设，因地适宜解决关键环节的实际问题。 (5)、关注罪犯的思想动态 面由心生，智由心生、念由心生要从罪犯客观心理主动出击耐心帮助其重塑人格点燃希望，细化教育环节注重成效。使其自觉醒悟，主动认罪伏法服从管理，接受改造。 (6)、切实落实工作制度和政策在任何工作中都要与时俱进，开拓创新，一线干警一定要在前线总结经验教训，遵守规则认真学习落实文明正确执法。 (7)、提高业务素质 在衣食住行的基础上，狱政应经常举办各种培训班提高干警素质，增强罪犯劳动技能。调查狱情，运用耳目，排查顽危犯，做好顽危犯得包夹，监控转化工作，发挥其内墙堡垒作用。 在干警的长期努力下，有些罪犯的思想任无法走进监狱我们必须不谢努力调整方法，常备不懈，警钟长鸣。 (8)、改革执法环境，营造改造环境环境的好坏，与执法民警的工作态度监管改造的安全息息相关，罪犯的生活环境，医疗保障劳动环境的安全稳定服刑人员的思想起决定性因素营造一个公平;公正;公开的改造环境，实行人性化的管理，多关心，关怀罪犯的改造生活，出问题，从自身找原因，多教育;少批评;多表扬;多鼓励改善医疗环境，让病人别担心，监狱也是一个大家，温馨的人文关怀机制。 (9)、增强责任心。 责任心实做好一切的前提，，如果一个民警不用心执法，不用心工作，我想他不是已经不是不负责任，是不适应工作，无法胜任这份 8 天命。增强意识，坚定自我信念，抓住工作重心，掌握狱情动态，严格，精确控制罪犯。利用好现代设备技术，形成脉络化，全过程，全方位覆盖监管安全的新格局。科学开放的管理。 (10)、加强对罪犯亲情的关注 “罪犯”只是作为犯罪人在服刑期间的特定身份，刑满释放后，他们又将重新回归社会，同样需要融入社会，需要亲情，对于犯罪人来说，亲情是促进他改造的主要精神动力。 我认为罪犯在改造中最大的动力就是情人亲情了，就目前而言;监狱可以允许罪犯有条件地实行亲情共餐、住宿，在狱中与家人一起过生日;允许表现好的罪犯春节"放假”回家，允许死刑犯临刑前见家属;其次，要开通亲情电话，让罪犯每周可与家人通一次电话;要开辟亲情会见场所，表现好的罪犯每月可与配偶同居24小时;如果条件容许可以利用网络平台建立服刑改造QQ群，视频聊天，图片，单位问候等形式。这对罪犯而言是真正的人性化关怀，有利于他们保持同家庭和社会之间的正当联系，维系正常的亲情、友情，促使他们积极接受改造，争取早日出狱，开始新的生活。 9 (英文版 ) Two regulations promulgated for implementation is in the party in power for a long time and the rule of law conditions, the implementation of comprehensive strictly strategic plan, implementation in accordance with the rules and discipline to manage the party, strengthen inner-party supervision of major initiatives.
