Party A: China Minsheng Banking Corp., Ltd.,      Branch Legal Representative:  Address:                          Party B: Name:  Gender:                    Education Background:  Date of Birth:  ID Card No./ Passport No.:  Home Address:  Postcode: In light of the laws, codes and regulations concerned under the Labor Law of the People’s Republic of China and the Labor Contract Law of the People’s Republic of China, Party A and Party B sign this contract voluntarily about the issues of establishing labor relationship and each party’s right and obligation through fair negotiation on the basis of equality to abide by all the articles together. I. Contract Type and Service Period Article 1. The contract type chosen by Party A and Party B is              Labor Contract. (1). The fixed effective date of the labor contract shall start on      and terminated on       . (2) Without fixed period, the contract period begins from        . (3) The period of the contract will take certain work as the limit. The contract period begins from         to      and terminates when this work is completed. Article 2. If Party B starts to work on the date that is not in conformity with the date stipulated in the labor contract, the labor relationship shall establish on the date on that Party B actually starts to do his/her job. Article 3. The probation period agreed by Party A and Party B is from          to        . The salary of the probation period shall not be less than 80% of the standard salary. If Party B comes to work later or earlier than the date promised, then the probation period shall bring forward or put off accordingly. II. Working Contents and Place Article 4. Party B agrees to take on the         job responsibility in the  Department          in the working place:            as required by Party A. Party A may adjust the position of the employee if necessary or based on the evaluation and Party B has to accept the adjustment. Article 5. Party B shall take on the responsibilities as required and finish the job with high quality and quantity in time. Party B shall not do part-time job without Party A’s consent. III. Working Time and Rest and Holiday Article 6: Party A shall execute the       working hour system to Party B. (1) According to the fixed working hour system, Party B shall practice no more than     working system per day, and the average working time is no more than 40 hours per week. Party A shall guarantee that Party B shall have two days off every week. (2) If Party A executes the complex way of calculating working hours, then the average working time is no more than 8 hours per day and 40 hours per week. (3) If Party A executes the non-fixed time work system, Party B can arrange the off days by self under the precondition that he/she has finished the job duties on time. Article 7: In case Party A has to arrange Party B to work for extra hours or over-work on legal holidays for the needs of work, Party B shall observe Party A’s arrangement. Article 8: Party B shall obtain Party A’s consent if he/she works for extra hours, otherwise it will be not regard as work overtime. IV. Rules & Regulations and Labor Discipline Article 9: Party B shall strictly observe and perform all the laws, regulations, rules and social morality, professional ethics, and protect the reputation and interest of Party A. Article 10: Party A formulates, alters and completes the rules and regulations according to the law and inform the employers in time. Party B shall strictly obey each rules and regulations. Article 11: Party B shall not take on second job or activity in the industry same to that of the Company during the incumbency, and Party B shall keep secret Party A’s commercial secret, intellectual property and some other relevant issues.  Article 12: If Party B violates Party A’s labor disciplines, rules and regulations, Party A may take disciplinary sanction or economic penalty according to the provisions on punishment of violation in the rules and regulations of the Company or state, till relieve the contract.
