聘任合同中英文版

聘任甲方＿＿＿＿＿＿＿＿愿意聘请乙方＿＿＿＿＿＿＿＿作为外籍教师。双方本着友好合作的原则签署此合同并保证严格履行合同上所规定的条款。乙方的月工资为＿＿＿＿元/月，服务期限从＿＿＿＿年＿＿＿月＿＿＿日至＿＿＿＿年＿＿＿月＿＿＿日。一、甲方的义务A：甲方将向乙方介绍中国的法律及有关政策，学校的体制和相关的外教管理规定。B：甲方将知指导、监督和评估乙方的工作。C：甲方给乙方提供必要的工作设施和居住条件。D：甲方将指派一名教师作为乙方的工作联系人，协助其完成工作任务。E：甲方将按月付给乙方工资。二、乙方的义务A：乙方应遵守中国法律、规定和制度，并保证不从事与本人身份不符的活动。B：乙方应熟悉甲方的工作制度和相关的外教管理规定并接受甲方对工作的指导、安排、监督和评估。未经甲方许可，乙方不得在其它地方兼任工作或担任与甲方工作无关的职位。C：乙方将按约定的进度完成教学任务并保证教学质量。D：乙方应尊重中国的宗教政策并且不能够举办一些不适合教师身份的宗教活动。E：乙方应尊重中国的道德和社会习俗。三、合同的修改、取消和中止A：双方应遵守合同规定，未经双方许可不得擅自修改、取消和中止合同。B：经双方许可，可修改、取消和中止合同。在双方未达成新的之前，双方要严格遵守合同。C：甲方有权在以下情况下以书面形式乙方中止合同：1、乙方不能履行合同，或在甲方提出问题后，乙方仍不能履行条款列明的义务。2、乙方在请30天病假之后，经医生诊断不适宜再继续正常工作。D：乙方有权在以下情况下以书面形式通知甲方中止合同。1、甲方未能根据合同给乙方提供必要的工作和居住条件。2、甲方未能按规定给乙方报酬。四、违约处罚A：如果双方任何一方违反合同规定，应付数额为乙方一个月工资的违约金。B：如果乙方由于不可预见情况，要求取消合同，需提供有关部门证明并征得甲方同意，但需自付回程费用。C：如果乙方无正当理由擅自中止合同，需自付回程费用并要向甲方交付罚金。D：如果甲方由于不可预见情况要中止合同，应得到乙方的许可，但要负担其回程费用。E：如果甲方无正当理由擅自终止合同，不仅要负担乙方的回程费用而且要向乙方交付罚金。五、合同附件同正文具有同样效力。六、此合同自签署之日起生效并且于终止之日自动解除。如果双方中任何一方要求订立新合同。乙方自付在合同终止之后逗留的费用。七、调解双方将相互协商解决在合同执行过程中发生的争端。如果努力失败，可以上交外专局外国专家事务组调停。此份合同签于＿＿＿年＿＿月＿＿日签于＿＿＿＿＿，英文与中文各；一式两份。甲方：佛山科学技术学院乙方：（签名）：＿＿＿＿＿＿＿（签名）：＿＿＿＿＿＿附件：一、工资1、乙方的报酬根据乙方的工作量和专业技能，及其学历和教学经验所订。甲方将在乙方接受此职位之前告知乙方的报酬。2、报酬按月付给乙方，自乙方履行职责之日起至合同终止之日止。如果乙方工作不足一个月，则报酬按天数计（每天报酬为月薪的三十分之一）。3、甲方将付给乙方人民币＿＿＿＿＿元/月。4、乙方如有需要，甲方可协助乙方离境前申请兑换一定数额的外币。二、交通费用1、来程路费由甲方支付。如果乙方遵守合同并完成学年任务，由甲方提供其回国单程经济舱机票。2、如果服务期限是一学年或少于半年，甲方将付乙方回国单程机票的半额。三、证件费用1、甲方负责为乙方办理合同期间内居留证和外国专家证，并付办证费用。2、甲方负责为乙方办理单次往返签证。甲方可协助乙方伸办多次往返签证，但乙方需付额外费用。四、享受待遇1、甲方为乙方提供一套公寓，配有全套家具及必要的电器或燃器具，包括彩电、空调、冰箱、微波炉、热水器、燃气灶、取暖器、电话等。2、甲方为乙方支付每月电话月租费28元及不超过50元的人民币的市内电话费、不超过200元的水电费和不超过100元人民币的煤气开支。超额费用由乙方自付。3、乙方享受医疗待遇甲方教职工同等。乙方需付20%的医疗费用。常规治疗在校医院，经校医院医生准许乙方可在外就医，甲方支付在外就医费用但不包括挂号费、出诊、交通费、？牙、洗牙、配眼镜、整容、住院的餐费和非治疗性的补药费用，乙方家属不享受上述待遇。五、假期除大学课程安排表上的假期和本地的公众假期之外，乙方可享受两日的特别假期（如圣诞节），聘期为一学年以上者在学校假期时的工资照付六、病假和事假1、当乙方生病，凭医疗证明可请病假。如病情持续半个月，工资可照常发放。如病假超出期限，甲方有权终止合同。2、乙方在得到甲方的准许下可请事假，事假期间的报酬将按事假天数从工资中扣除，半年内累计请事假不得超过一周。七、工作量乙方的教学工作由＿＿＿＿＿负责人安排，其工作量为每周14课时。 甲方：乙方：（签名）：（签名）： 合同附件（一）一、工作任务（详细的授课内容、授课时间、授课对象）二、生活待遇l、薪金：校付（人民币元。其中可换外汇％）自理2、国际旅费：校付（单程/ 往返） 自理3、住房：校方提供双套间/ 单套间（配有卫生间、家具、自理卧具、电冰箱、电话、以及取暖和降温设备）4、校方为受聘方提供：公费医疗自理（其中挂号、出诊、就医交通、镶牙、洗牙、整容、按摩、配眼镜、住院用餐和服用非医疗性的滋补药品等费用自理）。三、工作时间和休假1、外国教师每日工作时间为八小时，每周工作时间为五天．2、外国教师享受中国下列节日休假：（l）元旦（2）春节（3）国际劳动节（4）国庆节（5）法律、法规规定的其他休假节日3、外国教师可按其国籍和信仰相应享受下列节日休假：（l）圣诞节两天（2）宰牲节（古尔邦节）三天（3）开斋节一天（4）泼水节一天聘方受聘方合同附件（二）第一条外籍教师实行带薪年休假。合同期为一学年的，享受一个假期（寒假或暑假）带薪休假。第二条外籍教师请病假，须凭北京大学校医院或指定的涉外医院（友谊宾馆门诊部、协和医院）医生证明。第三条根据聘用单位指定医院医生的诊断证明，外籍教师在一个合同期内累计请病假不满三十天工资按100％；超过三十天后，聘用单位有权解除聘用合同；若解除合同，工资可按70％ 发给，直至恢复工作为止。第四条在合同期内，外籍教师因私外出就诊的费用自理。合同期内，在台湾、香港、澳门地区和中国境外就诊的医疗费用自理。第五条外籍教师请事假须经聘用单位同意，可按日扣发工资。在合同期一学年内，事假累计不得超过十天，连续事假不超过三天。超过一天，可扣发两天工资。第六条未经聘用单位同意而擅离职守的，旷职一天，扣发三天工资。情节严重的，我校有权解除合同，并追究其违约责任。聘方  受聘方PartyAwishestoengagetheserviceofPartyB＿＿＿＿asaforeignexpert/teacher.Thetwoparties,inaspirtoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.PartyB’smonthlysalarywillbe＿＿＿＿RMBYuan.Theperiodofservicewillbefromthe＿＿＿dayof＿＿＿,2000tothe＿＿＿dayof＿＿＿,2001.Ⅰ.PartyA’sObligations1.PartyAshallintroducetoPartyBtheChineseLaws,decreesandrelevantregulations,thePartyA’sworksystemandregulationsconcerningadministrationofforeignteachers.2.PartyAshallconductdirection,supervisionandevaluationofPartyB’swork.3.PartyAshallprovidePartyBnecessaryworkingandlivingconditions.4.PartyAshallappointateacherasPartyB’scontactpersontoassisthis/herwork.5.PartyAshallpayPartyB’ssalarymonthly.Ⅱ:PartyB’sObligations1.PartyBshallobservetheChineselaw,decreesandrelevantregulations,andshallnotpaticipateintheactivitiesirrelevanttohis/herstatus.2.PartyBshallobservePartyA’sworksystemandregulationsconceringadminstrationofforeignteachersandshallacceptPartyA’sarrangement,direction,supervisionandevaluationinregardtohis/herwork.withoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreeonwithPartyA.3..PartyBshallcompletetheteachingtasksagreedonscheduleandguaranteethequalityofwork.4.PartyBshallrespectChina’sreligiouspolicyandshallnotconductreligiousactivitiesincompatiblewiththestatusofateacher.5.PartyBshallrespecttheChinesepeople’smoralstandardsandcustoms.Ⅲ.Revision,CancellationandTerminationoftheContract1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.2.Thecontractcanberevised,canceledorterminatedwithmutualconsent.Beforebothpartieshavereachedanewagreement,thecontractshouldbestrictlyobserved.3.PartyAhastherighttocancelthecontractunderthefollowingconditions:(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.(2)Accordingtothedoctor’sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.4.PartyBhastherighttocancelthecontractwithawrittennoticetoPaertyAunderthefollowingconditions.(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.(2)PartyAhasnotpaidPartyBasscheduled.Ⅳ:BreachPenalty1.Wheneitherofthetwopartiesfailstoful
