个人信息论文：未成年学生个人信息的法律保护个人信息 权利冲突 法律保护 个人信息论文:个人信息 权利冲突 法律保护 【中文摘要】综观现有的学术研究成果,对未成年学生的个人信息保护主要集中在网络保护这一子领域,谈论的大多是网络环境下或者说是数字化了的未成年学生个人数据和隐私的保护,而缺少对现实世界中的未成年学生个人信息的保护研究。比如,学校、家庭、老师和媒体等侵犯学生隐私权的事情时有发生,有的甚至造成非常严重的后果。学生的个人信息权利得不到应有的尊重和保护,对未成年学生的身心健康发展极为不利。当代发达国家,其法制比较完善,对未成年学生这一特殊群体的权益基本上都进行了较完善的专门立法。他们不单重视未成年学生的福利,由于法制观念深入人心,对未成年学生的财产权、人身权等权利都给予了全面的法律保护。本文尝试采用实证分析和比较分析的方法,一方面,通过收集现实中的典型案例资料,以探寻未成年学生个人信息保护的价值和意义。另一方面,本文收集了国内外包括我国台湾地区、香港和澳门特别行政区在内的规范性法律文件和相关资料,通过对法律规范的背景、立法精神和实际效果的分析和考察,对比国外在未成年学生个人信息法律保护方面的先进制度,针对我国目前未成年学生个人信息保护方面存在的问,探讨如何构建我国未成年学生的个人信息保护制度。除引言和结语外,本论文分四个部分:第一部分:对未成年学生个人信息的概念进行界定,明确了未成年学生个人信息的内涵。同时,在比较和分析的基础上,列举了未成年学生享有的个人信息权利。第二部分:阐述未成年学生 个人信息保护的特殊性,一方面未成年学生的个人信息权利受到社会 公共利益的限制。另一方面,未成年学生的个人信息权利与亲权、监 护权和学校的行政管理权之间存在冲突。第三部分:在比较法研究的 基础上分析了欧盟、美国和我国台湾地区的未成年个人信息立法以及 法律保护概况,为我国的未成年学生个人信息保护立法提供借鉴和参 考。第四部分:在综合分析的基础上,论证了我国未成年学生个人信 息保护应该采取的立法模式、立法基本原则。同时,提出了制定个人 信息保护法的立法建议。 【英文摘要】Make a comprehensive view of all the academic research achievements of the minor students’ personal information protection, mainly concentrated in the sub-fields of network, and what we mostly talk about is under the network environment, but we also found the shortage of research because of a lack of the minor students personal information protection and research in present world. For example, school, family, teachers and the media infringe students’ privacy very often, and sometimes cause serious consequences. If students’ personal information rights can not be respected and protected, it is harmful to the health of minor. The legal system to minor student is perfect at developed countries. They not only value due to minor student welfare. but also given full legal protection to minor student thorough popular feeling, such as property rights, personal rights and other rights.This paper tries to use empirical analysis and comparative analysis method. On one hand, by collecting the reality of typical cases and information explore the value and meaning of personal information protection. On the other hand, this paper collects all the dates at home and abroad, analysis the legal norm background, legislative spirit and practical effect, then contrast the advanced system of protection minor students in foreign countries, point out the questions in China, at last discusses how to construct a minor students’ personal information protection system.In addition to the introduction and conclusion, this paper points four parts:Part 1:definite the concept of minor student, clear the connotation of personal information. Meanwhile, lists the minor students’personal information rights in the basis of comparison and analysis.Part 2:in this paper, expounding the particular of the minor students’ personal information protection. On the one hand, the minor students’ personal information rights are limit by social public interests. On the other hand, there has confliction between the minor students’ personal information right and other rights, such as guardi anship, paternityPart 3:on the basis of comparative study of minor personal information legislation of EU, U.S.A and Taiwan. Part 4:on the basis of all the analyzing, I discuss what is the legislative model and basic principles our country should take.
