That shadow 关于农民工群体法律援助的探讨 摘要:转型期的农民工群体是我们当前社会的一个特殊边缘性群体，由于自身及外部环境等方面的原因导致他们的利益受损，而法律援助作为社会救助体系中的一项重要手段将在帮助维护农民工群体自身利益方面起到重要作用， 关键词:农民工 法律援助 现状分析 对策思路 正文: 一、关于农民工的法律援助 社会转型是当前我国社会变迁的主要特征，特别是农村家庭联产承包体制的改革极大地提高了农村的生产力，在这一过程当中解放了一批人也造就了这样一类群体，他们背着农民的户籍身份但终其自己的力量努力在城市建设中谋求自己的生存手段，他们有着自己既区别于传统农民又不同于城市市民的称呼“农民工”。针对于整个农民群体而言，他们可以说是开拓者，乘着体制改革和改革开放浪潮的东风他们摆脱了束缚他们祖祖辈辈的土地，希望能在参与城市化建设的过程当中争取更好的生活质量。一部分群体通过了各种手段获得了自己的成功，改变了自己的命运，但绝大部分群体游离于城市和农村之间，他们既不纯粹的甘当于农民，也无法获得合理的市民身份，这种尴尬的身份让他们成为我们社会的边缘性群体。 法律援助是国家本着公平正义的理念主动承担起对公民法律救助的责任，这是现代社会发展强调公民权的重要体现。就其定义而言有广义与狭义之分，广义的法律援助是国家对因经济困难或其他原因而难以通过正常的法律救济 ,,,手段保障自身基本权利的社会弱者提供法律帮助的一项法律保障。而狭义的法律援助是指在国家设立的法律援助机构的组织、指导和统一协调下，律师、公证员、基层法律工作者等法律服务人员，为经济困难者或特殊案件的当事人给予减、免收费，提供法律帮助，以保障实现其合法权益，完善国家司法 ,,,公正机制，健全人权及社会保障机制的一项法律制度。就援助对象而言，当前的绝大多数农民工群体是属于这一援助范围的，当他们在城市务工的过程中遇到诸如劳动争议、交通事故、婚姻家庭纠纷以及相关刑事案件时可以向相关援助机构寻求法律咨询和司法救助等帮助。在这些方面，法律援助制度的实行有利于保障农民工群体的利益得到维护。法律援助制度已经成为一个国家经济发达、法制健全、社会文明的重要标志，是我们当前进行和谐社会建设的重要要求。 二、农民工法律援助的现状分析 当前农民工法律援助的现状主要包括两个方面:一方面是关于农民工法律援助工作的必要性分析，另一方面是农民工法律援助所存在的一些问题的探究。这两个问题的讨论首先明确了当前我们需要对农民工群体实施法律援助的紧迫性和必要性，同时分析了我们当前在贯彻实施法律援助的过程中可能要解决的一些问题，这些问题的解决是我们真正将对农民工群体的法律援助做到实处的保障。 days of Drudge, illness increased, he Chong soon Fatt said: "it seems that I'm not dead to Japan soldiers tortured to death, and it certainly can not go home alive, even with small Japan fight and get it over, if you have the opportunity to get away."
