One is to speed up the construction. 2、转让后改变用途等土地使用条件的情况下,应缴纳的土地使用权出让金额按以下公式计算: 应缴纳的土地使用权出让金额=拟出让时的新土地使用条件下出让土地使用权市场价格-拟出让时的原土地使用条件下划拨土地使用权权益价格。 《中华人民共和国城镇国有土地使用权出让和转让暂行条例》第十四条规定,土地使用者应当在签订土地使用权出让合同后六十日内,支付全部土地使用权出让金。逾期未全部支付的,出让方有权解除合同,并可请求违约赔偿。 六、减免土地出让金造成国有土地资产流失的,要承担法律责任 《中华人民共和国土地管理法》第五十五条规定:以出让等有偿使用方式取得国有土地使用权的建设单位,按照国务院规定的标准和办法,缴纳土地使用权出让金等土地有偿使用费和其他费用后,方可使用土地。 《安徽省国有土地使用权出让金征收管理实施办法》(财综字[1995]第326号)第四条规定:财政部门是土地出让金收入的主管机关,土地行政管理部门是土地出让金的代征机关。 国务院《关于加强国有土地资产管理的通知》(国发[2001]15号)第二项中指出:要进一步加强国有土地收益的征收和管理,任何单位和个人不得减免和挤占土地出让金、租金等土地收益。对于低价出让、租赁土地,随意减免地价,挤占挪用土地收益,造成国有土地资产流失的,要依法追究责任。 《协议出让国有土地使用权规定》第十七条规定,减免国有土地使用权出让金的,对直接负责的主管人员和其他直接责任人员依法给予行政处分。 综上所述,土地使用者以出让方式取得土地使用权,就必须支付出让金。国土部门仅是土地出让金的代征机关,无权减免土地出让金,越权违规减免的,要被依法追究责任。 七、未经批准擅自转让、出租、抵押划拨土地使用权的行为应承担哪些法律责任 《中华人民共和国城市房地产管理法》第六十六条规定:本法第三十九条第一款的规定转让房地产的,由县级以上人民政府土地管理部门责令缴纳土地使用权出让金,没收违法所得,可以并处罚款。 《中华人民共和国城镇国有土地使用权出让和转让暂行条例》第四十六条规定:对未经批准擅自转让、出租、抵押划拨土地使用权的单位和个人,市、县人民政府土地管理部门应当没收其非法收入,并根据情节处以罚款。 八、划拨土地使用权抵押效力如何认定 《最高人民法院关于破产企业国有划拨土地使用权应否列入破产财产等问题的批复》(法释〔2003〕6号)第二条规定:企业对其以划拨方式取得的国有土地使用权无处分权,以该土地使用权为标的物设定抵押,除依法办理抵押登记手续estructuring, encouraging private enterprises and SMEs to become new force to attract foreign investment. One is to speed up the construction. 外,还应经具有审批权限的人民政府或土地行政管理部门批准。否则,应认定抵押无效。如果企业对以划拨方式取得的国有土地使用权设定抵押时,履行了法定的审批手续,并依法办理了抵押登记,应认定抵押有效。根据《中华人民共和国城市房地产管理法》第五十条和《中华人民共和国担保法》第五十六条的规定,抵押权人只有在以抵押标的物折价或拍卖、变卖所得价款缴纳相当于土地使用权出让金的款项后,对剩余部分方可享有优先受偿权。但纳入国家兼并破产的国有企业,其用以划拨方式取得的国有土地使用权设定抵押的,应依据国务院有关文件规定办理。 九、破产企业国有划拨土地使用权应否列入破产财产 最高人民法院《关于破产企业国有划拨土地使用权应否列入破产财产等问题的批复》(法释〔2003〕6号)第一条规定:根据《中华人民共和国土地管理法》第五十八条第一款第(四)项及《城镇国有土地使用权出让和转让暂行条例》第四十七条的规定,破产企业以划拨方式取得的国有土地使用权不属于破产财产,在企业破产时,有关人民政府可以予以收回,并依法处置。纳入国家兼并破产计划的国有企业,其依法取得的国有土地使用权,应依据国务院有关文件规定办理。 十、在哪些情况下可以收回划拨土地使用权 《中华人民共和国城镇国有土地使用权出让和转让暂行条例》第四十七条规定:无偿取得划拨土地使用权的土地使用者,因迁移、解散、撤销、破产或者其他原因而停止使用土地的,市、县人民政府应当无偿收回其划拨土地使用权,并可依照本条例的规定予以出让。 对划拨土地使用权,市、县人民政府根据城市建设发展需要和城市规划的要求,可以无偿收回,并可依照本条例的规定予以出让。 无偿收回划拨土地使用权时,对其地上建筑物、其他附着物,市、县人民政府应当根据实际情况给予适当补偿。 十一、批地、发证权在县级以上人民政府 《中华人民共和国土地管理法实施条例》第二十二条规定,具体建设项目需要占用土地利用总体规划确定的城市建设用地范围内的国有建设用地的,建设单位持建设项目的有关批准文件,向市、县人民政府土地行政主管部门提出建设用地申请,由市、县人民政府土地行政主管部门审查,拟订供地,报市、县人民政府批准;需要上级人民政府批准的,应当报上级人民政府批准。供地方案经批准后,由市、县人民政府向建设单位颁发建设用地批准书。 《安徽省实施〈中华人民共和国土地管理法〉办法》第二十七条规定, 具体建设项目使用原有建设用地和已批准农用地转用、土地征用范围内的土地的,以及农村集体经济组织依法使用农民集体所有的未利用地进行非农业建设的,报土地所在地的市、县人民政府批准。 《建设用地审查报批管理办法》第十一条第一款规定,有关土地行政主管部门收到上报的建设项目呈报说明书和有关方案后,对材料齐全、符合条件的,应当在estructuring, encouraging private enterprises and SMEs to become new force to attract foreign investment.
