保健食品假冒批准文号该如何依法处置 今年3月，某市药监部门接到群众投诉，反映其购买的保健食品质量存在疑问。经核实，该保健食品假冒合法企业厂名及保健食品批准文号。药店购进产品时索要了供货方及产品资质，手续齐备。至药监部门检查时，药店已将该产品下架停售，并将库存产品退回了外地供 货方，共销售了5盒该产品，销售金额为600元。 案件定性引争议 执法人员针对本案的定性提出了4种观点: 第一种观点认为，《食品卫生法》废止后，国家尚未出台有关保健食品的监管，因此，目前对于销售假冒保健食品的处理于法无 据。 第二种观点认为，虽然国家尚未出台保健食品监管法规，但根据《中华人民共和国卫生部公告》(2011年第5号)，《保健食品》仍为现行有效的部门规章，本案中的假冒保健食品未获得审查批准，违反了《保健食品管理办法》第16条规定，属于《国务院关于加强食品等产品安全监督管理的特别规定》(以下简称《特别规定》)第3条第二款“不符合法定要求的产品”，可按此规定进行处 理。 第三种观点认为，本案中的假冒保健食品在包装标示上冒用合法企业厂名和批准文号，违反了《食品安全法》第51条第二款“声称of work enthusiasm and forward-looking.
