The issue of legal retirement age in China has recently drawn intensive attention from all walks of society. In China, the current relevant laws and regulations provide that . The retirement age disparity is reflected in differences in gender and social status. Gender difference, the former, causes the retirement age of average male and female workers to be different by 5 years, while it would be 10 years between male and female cadres. The article 48 of our constitution says that women in the People’s Republic of China enjoy equal rights with men in all aspects of political, economic, cultural, social and family life. Women retire five years earlier than men can be interpreted as a case of depriving them of 5-year labor right, with their political, economic and cultural rights being impacted in the meantime.
However, the historical conditions and background under which these provisions were made have changed greatly as time went on, which leads to wide questioning over whether the retirement system being adopted currently is reasonable. As a result, clamor for a reform of the current retirement system has grown louder, in order for the equality between men and women.
A desire for an equal and fair retirement system is going to be justified as follows. First of all, the lifespan of women in China is becoming averagely longer than that of men, which I think is being noticed increasingly by us, especially by men. The education gap that ever lied between men and women has shrunk with the development of the economic society we are living in. This can be testified by some reports that the amount of female has come to overpass the number of men in many universities. So it would be a boon to the whole society for men and women to retire at the same age, or at least, to narrow down the retirement age disparity, which I deeply believe is supposed to be an inevitable trend of society in which much progress has been made in human civilization.
Second, different retirement age would impact the labor market to a certain extent. Earlier retirement age for women will make the properly full use of human capital, especially those well-educated female, fall into an adverse situation. Simultaneously, in addition to slowing down the capital investment initiative of women, it would also make female lie in a relatively adverse position of promotion.
Last but not least, female retire in an earlier age will put more pressure on Pension Insurance System by increasing larger number of people to pay. Another picture of this is some retired female find the pension is such unsupportable that an enjoyable post-retirement life is out of reach or find themselves remain so keen on working that they become willing to find another job. Na mely, they retire, but aren’t in rest. So it would be a reasonable suggestion that Chinese government is expected to raise the female retirement age, regulating in a step-by-step manner by taking changes of population of labor force into consideration in order to optimize the labor market supply.
The delay of retirement age will bring different impact on different people, which requires the reform of retirement age to cover the very needs of people of every walks by means of designing a flexible policy. To do this, something must be taken into consideration.
First, retirement age should vary in different vocations. Features of both mental
labor and manual labor should be contained in the scientific proposal about the reasonable retirement age.
Second, also the last, retirement age should vary in different employment types. Interest of the flexible employment personnel, the unemployed and the laid-off should be particularly taken into consideration.
Over the last half century, mountains of efforts have been made to improve women’s legal status and every means has been tried to strengthen legal assuranc e of female rights. The rights and interest of women can find its place in many laws, including the constitution, Law of Succession, Marriage Law, Labor Law, Civil Procedure Law, Criminal Law, Criminal Procedure Law, and so forth. However, here remains a long-run and tough task to achieve a virtual equality between men and women in our real life.
