Insist on seeking 湖南省水路交通管理条例 湖南省第九届人民代表大会常务委员会第十三次会议 第一章 总则 第一条 为加强水路交通管理，保障水路交通安全、畅通，提高水路交通运输效益，维护水路交通投资者、经营者和服务对象的合法权益，根据国家有关法律、行政法规的，结合本省实际，制定本条例。 第二条 本条例适用于本省行政区域内水路交通的规划与建设、港口业务、运输与运输服务、交通安全、船舶修造及其有关活动。 第三条 发展水路交通事业，应当充分利用和合理开发水资源，发挥水资源的综合效益，加强生态环境的保护。 鼓励境内外单位和个人投资兴办水路交通事业。 投资兴办水路交通事业，实行谁投资、谁受益的原则。 第四条 县级以上人民政府应当将水路交通事业纳入国民经济和社会发展计划，统筹安排，合理规划，支持和保障水路交通事业的发展。 第五条 省人民政府交通行政管理部门负责全省水路交通监督管理工作。自治州、设区的市、县(市、区)人民政府交通行政管理部门按照职责分工，负责本辖区内的水路交通管理工作。水路交通具体管理工作，分别由港口、航道、航运、港航监督、船舶检验、规费征稽等水路交通管理机构负责。 县级以上人民政府其他有关部门应当按照各自职责协同做好水路交通管理工作。 第二章 规划与建设 第六条 县级以上人民政府交通行政管理部门应当根据上一级水路交通发展规划、江河流域综合治理规划、本地区国民经济和社会发展计划的需要，编制本地区水路交通发展规划，经上一级交通行政管理部门同意，报本级人民政府批准后实施。 第七条 水路交通建设应当按照批准的水路交通发展规划进行，符合基本建设程序、技术和行洪安全要求。 第八条 县级以上人民政府交通行政管理部门应当会同河道管理等有关部门根据水路交通发展规划提出港口区域划定，报本级人民政府批准。 港口区域包括水域和陆域。港口区域划定后，应当设立区域标志，不得擅自变更。 在港口区域内兴建与改造建筑物和构筑物、使用港区岸线、进行水上水下施工作业、设置非港航业务标志以及其他开发利用活动，应当报经水路交通管理机构和有关行政管理部门批准，并采取相应的保护措施。 第九条 以改善水路交通条件为目的，采取贷款、引进外资等方式筹集资金建设的水路交通设施，经省人民政府批准，可以实行有偿使用。 交通部门建设航运枢纽，在符合电力发展规划、不影响行洪的条件下，经批准可以建设电站工程，实行以电养航。 第十条 在通航河流上兴建临河、跨河和拦河的工程建设项目及其他设施，建设单位应当事先报经有关水路交通管理机构和河道管理机构审查同意，并按基本建设程序规定办理有关审批手续。 按前款规定兴建的工程建设项目及其他设施影响行洪的，建设单位应当按规定进行整改;中断通航的，建设单位应当按照通航标准同时修建免费通行的过船设施;影响航行安全的，水路交通管理机构应当加强安全管理，按照国家有关规定设置航标和安全防护设施，并负责维护管理，其费用由建设单位或者业主承担。 第十一条 在通航河流上的过船设施需要检修且影响通航的，业主应当选择在枯水季节development of problem, insisted liberation thought, and times, set on new development concept of consciously confidence, do advocate innovation, and focused on coordination, and advocate green, and thick plant open, and advance shared. Insist on seeking 进行，在检修的三十日前报请水路交通管理机构发布航行通告。 在通航河流上进行建设施工或者检修过航设施，中断通航或者恶化通航条件的，建设单位或者业主应当按省有关规定对受影响的水路运输经营者给予适当补偿，并在规定期限内负责恢复通航。 第十二条 在不通航河流或者人工水道上建设闸坝后可以通航的，建设单位应当同时建设适当规模的过船设施;不能同时建设的，应当预留建设过船设施的位置。过船设施的建设费用，除国家另有规定外，应当由交通部门承担。 第十三条 港口区域以外的码头建设，应当统筹规划、合理布局，符合安全规定和行洪要求，并按照规定的程序报批。 乡、村渡口的设置、迁移、撤销，必须按照规定报经县级以上人民政府批准。禁止擅自设置码头和渡口。 第十四条 航道、港口和水路交通设施受国家保护，任何单位和个人不得侵占、破坏或者损毁，不得擅自迁移或者改作他用。 禁止在航道和港口区域内设置碍航渔具和种植水生物、倾倒固体废弃物或者超标排放污染物。 第十五条 在通航河流挖砂取土、采金，应当依法经河道管理机构、水路交通管理机构和有关行政管理部门批准，并按照批准的范围和方式作业，不得恶化通航条件，影响行洪、航行安全。 第十六条 进行航道、港口建设及养护，不得淤积河道，影响行洪。对正常的航道、港口建设及养护，有关单位应当配合，不得干涉、阻挠、设置障碍或者在法律、法规规定之外收取费用。 第十七条 水路交通建设用地，依照法律、法规和省人民政府的有关规定执行。经批准的建设用地，不得擅自改变用地性质;确需改变用地性质的，须经原批准机关同意。 第十八条 在通航河流上设立水路收费、检查站(卡)的，应当经省人民政府批准。 禁止在通航河流上非法设站(卡)、收费或者乱罚款。 第三章 营业运输与运输服务 第十九条 县级以上人民政府交通行政管理部门应当根据国家产业政策和社会运力、运量及船舶结构的实际，引导发展优质、节能的船舶投入营运;对耗能高、速度慢、技术性能差的船舶应当逐步淘汰。 第二十条 从事营业性水路运输、水路运输服务、港口业务的单位和个人，必须具备国家和省规定的相应条件，分别取得水路运输、水路运输服务、港口业务经营许可证，并凭证向当地工商行政管理部门申请登记，领取营业执照后，方可从事相关业务。 第二十一条 水路运输、水路运输服务和港口业务的经营者应当遵守下列规定: (一)持经审验的有效证照，在核准的经营范围内从事经营活动; (二)不得垄断客货源、强行代办服务以及超标准收取服务费用; (三)按规定纳税并代收代缴由货主缴纳的有关港口费用; (四)使用国家和省规定的运输票据; (五)船舶排污不得超过规定标准。 第二十二条 旅客运输船舶应当按照规定悬挂航线标志、票价表，并按照批准的航线、班次、始发时间、停靠点航行。确需取消或者变更批准的航线、班次、始发时间、停靠点的，必须经原审批机关批准，并在取消或者变更十五日前在有关站、点进行公告。因不可抗力需临时取消或者变更的除外。 禁止非法转让航线经营权。 第二十三条 水路运输、水路运输服务和港口业务的经营者应当加强对从业人员和设施act according to the law, establish the correct achievements view, and strive to create a stand the inspection of practice, people and history of performance. Insist on seeking 的管理，维护运输秩序，为旅客、货主提供安全、文明、舒适的环境。禁止刁难、敲诈、欺骗旅客和货主。 第二十四条 因水路运输、水路运输服务或者港口业务经营者的责任，造成旅客漏乘、误乘的，应当及时处理，设法将旅客送往目的地;造成旅客人身伤害或者货物误发、丢失、损坏、灭失、运输延误的，应当赔偿损失。 第二十五条 防汛、抢险、救灾、军事需要的物资以及省人民政府确定的重点物资需要通过水路运输的，承运人和港口业务经营者必须完成所承担的运输任务。因承担运输任务所发生的费用及造成的损失，按照国家和省人民政府有关规定给予补偿。 第二十六条 船舶买卖、租赁应当接受有关水路交通管理机构的监督管理。无有效证件的船舶，不得买卖、租赁。 第二十七条 船舶设计单位、船舶修造企业应当具备国家和省规定的船舶设计或者修造资质条件，不具备条件的不得从事船舶设计、修造。 船舶以及船用产品应当按照国家规定申请检验。未经检验或者经检验不合格的，不得出厂、航行或者使用。 第四章 交通安全 第二十八条 各级人民政府应当加强对本辖区水路交通安全管理工作的领导，建立健全安全工作责任制。 交通行政管理部门及其水路交通管理机构应当加强水路交通安全宣传教育和监督管理，维护水路交通安全秩序，保障水路交通安全、畅通。 从事水路交通活动的单位和个人，应当遵守水路交通安全规定和安全技术操作规程，负责对所属船舶、设施及人员的管理，落实岗位安全责任制。 第二十九条 船舶所有者或者经营者应当按照国家规定配备持有合格职务证书或者合格证件的船员。船舶进出港口，应当办理进出港签证或者接受检查。 船舶、排筏、设施停泊或者作业不得妨碍其他船舶、排筏正常航行。禁止船舶超载运输、超航区航行和不具备载客条件的船舶载客。 无船名船号、无船籍港、无船舶证书的船舶和报废的船舶，不得航行、作业。 第三十条 船舶储存、装卸、运输危险货物，应当遵守国家和省有关危险物品安全管理规定，并接受有关主管部门的监督管理。 码头、趸船储存、装卸危险货物以及在航道、航道沿岸设置水上加油站点，应当经水路交通管理机构和有关行政管理部门批准。 第三十一条 利用船舶、排筏从事游览、漂流、娱乐、餐饮等经营活动的，应当在水路交通管理机构划定的水域内航行或者停泊，不得影响航行安全和污染水域环境。 第三十二条 乡镇人民政府对本辖区所属乡镇船舶、乡镇船舶修造和渡口的安全负有直接管理责任。有关水路交通管理机构对乡镇船舶及渡口安全实施监督和业务指导。 第三十三条 对严重超载、无证驾驶、违法运输危险物品等危及人身安全的船舶，水路交通管理机构应当采取必要措施中止其航行，并及时依法处理。 第三十四条 船舶、排筏、设施发生水路交通事故，其所有者或者经营者应当采取措施组织自救，并迅速向当地人民政府、交通行政管理部门或者水路交通管理机构报告;有关单位接到报告后，应当立即派员赶赴现场组织抢救，并按照各自职责调查处理。 水路交通事故现场附近的船舶、排筏、设施或者人员收到求救信号后，应当立即采取措施，全力救助遇险人员。事故当事人和肇事船舶应当配合、接受事故处理机构的调查处理，不得擅自离开事故现场。 第三十五条 沉没在通航水域的船舶、排筏、设施，其所有者或者经营者应当在沉没水面按照国家规定设置明显标志，并在限定时间内打捞、清除。逾期未打捞、清除的，水路交development of problem, insisted liberation thought, and times, set on new development concept of consciously confidence, do advocate innovation, and focused on coordination, and advocate green, and thick plant open, and advance shared. Insist on seeking 通管理机构有权采取措施强制打捞、清除，其费用由沉船沉物的所有者或者经营者承担。因未按规定设置明显标志以及在限期内未打捞、清除而导致交通事故的，沉船沉物的所有者或者经营者应当承担造成事故的相应责任。因特殊情况无法设置标志或者打捞、清除的，水路交通管理机构应当及时处理。 前款规定不影响沉船沉物的所有者或者经营者依法向第三方索赔的权利。 第三十六条 在正常情况下，水电站的泄水应当保证航行流量。因抗旱或防洪等特殊原因需减少或者加大泄水流量，有关部门应当提前水路交通管理机构，并协助水路交通管理机构采取有效措施保证航行安全。 第五章 法律责任 第三十七条 违反本条例第十八条第二款规定在通航河流上非法设站(卡)的，由交通行政管理部门会同有关部门予以拆除，对违法收取的费用予以收缴，并对有关主管负责人或者直接责任人员依法给予行政处分。 第三十八条 违反本条例规定，有下列行为之一的，除法律、法规授权的外，由交通行政管理部门进行处罚: (一)违反第八条第三款规定的，责令改正，情节严重的，处五百元以上五千元以下的罚款; (二)违反第十三条第二款、第三款规定的，责令改正，限期拆除，没收违法所得，可并处五百元以上五千元以下的罚款; (三)违反第十五条规定，未经水路交通管理机构批准，在通航河流挖砂取土、采金的，责令停业，补办手续，限期清除碍航物体，可并处一千元以上二千元以下的罚款; (四)违反第二十条、第二十一条第(一)项规定，未经许可从事港口业务经营或者超越核准的经营范围从事水路运输、水路运输服务和港口业务经营活动的，没收违法所得，可并处一千元以上一万元以下的罚款; (五)违反第二十二条第二款规定的，责令改正，没收违法所得; (六)违反第二十七条第一款规定的，责令停业，没收违法所得，可并处五千元以上二万元以下的罚款; (七)违反第二十九条第二款规定的，责令改正，给予警告，可并处五百元以上五千元以下的罚款;违反第二十九条第三款规定的，责令改正，没收违法所得，拒不改正的，没收船舶。 第三十九条 本条例未作处罚规定的违法行为，法律、法规规定处罚的，从其规定。 第四十条 交通行政管理部门或者水路交通管理机构的工作人员依法执行职务时应当出示证件;扣留证件、罚款、暂扣或者没收船舶应当依法出具有效凭据。 第四十一条 交通行政管理部门和水路交通管理机构及其工作人员违反本条例规定，玩忽职守、徇私舞弊、滥用职权，构成犯罪的，依法追究刑事责任;不构成犯罪的，依法给予行政处分;给当事人造成损害的，应当依法承担赔偿责任。 第六章 附则 第四十二条 货物港务费等水路交通规费的征收、稽查和管理，依照《湖南省交通规费征收管理条例》的规定执行。 第四十三条 本条例所称港口业务，是指在港口区域内的货物装卸、搬运、运输、仓储、驳运和设施维修以及旅客服务等。 第四十四条 体育用船舶和渔业船舶的管理，按照有关法律、法规的规定执行，但改变用途从事水路运输的，应当遵守本条例。 第四十五条 本条例自2000年3月1日起施行。 act according to the law, establish the correct achievements view, and strive to create a stand the inspection of practice, people and history of performance. Insist on seeking 第九条 以改善水路交通条件为目的，采取贷款、引进外资等方式筹集资金建设的水路交通措施，经省人民政府批准，可以实行有偿使用。 交通部门建设航运枢纽，在符合电力发展规划、不影响行洪的条件下，经批准可以建设电站工程，实行以电养航。 第十条 在通航河流上兴建临河、跨河和拦河的工程建设项目及其他设施，建设单位应当事先报经有关水路交通管理机构和河道管理机构审查同意，并按基本建设程序规定办理有关审批手续。 按前款规定兴建的工程建设项目及其他设施影响行洪的，建设单位应当按规定进行整改;中断通航的，建设单位应当按照通航标准同时修建免费通行的过船设施;影响航行安全的，水路交通管理机构应当加强安全管理，按照国家有关规定设置航标和安全防护设施，并负责维护管理，其费用由建设单位或者业主承担。 第十一条 在通航河流上的过船设施需要检修且影响通航的，业主应当选择在枯水季节进行，在检修的三十日前报请水路交通管理机构发布航行通告。 在通航河流上进行建设施工或者检修过船设施，中断通航或者恶化通航条件的，建设单位或者业主应当按省有关规定对受影响的水路运输经营者给予适当补偿，并在规定期限内负责恢复通航。 第十二条 在不通航河流或者人工水道上建设闸坝后可以通航的，建设单位应当同时建设适当规模的过船设施;不能同时建设的，应当预留建设过船设施的位置。过船设施的建设费用，除国家另有规定外，应当由交通部门承担。 第十三条 港口区域以外的码头建设，应当统筹规划、合理布局，符合安全规定和行洪要求，并按照规定的程序报批。 乡、村渡口的设置、迁移、撤销，必须按照规定报经县级以上人民政府批准。禁止擅自设置码头和渡口。 第十四条 航道、港口和水路交通设施受国家保护，任何单位和个人不得侵占、破坏或者损毁，不得擅自迁移或者改作他用。 禁止在航道和港口区域内设置碍航渔具和种植水生物、倾倒固体废弃物或者超标排放污染物。 第十五条 在通航河流挖砂取土、采金，应当依法经河道管理机构、水路交通管理机构和有关行政管理部门批准，并按照批准的范围和方式作业，不得恶化通航条件，影响行洪、航行安全。 第十六条 进行航道、港口建设及养护，不得淤积河道，影响行洪。对正常的航道、港口建设及养护，有关单位应当配合，不得干涉、阻挠、设置障碍或者在法律、法规规定之外收取费用。 第十七条 水路交通建设用地，依照法律、法规和省人民政府的有关规定执行。经批准的建设用地，不得擅自改变用地性质;确需改变用地性质的，须经原批准机关同意。 第十八条 在通航河流上设立水路收费、检查站(卡)的，应当经省人民政府批准。 禁止在通航河流上非法设站(卡)、收费或者乱罚款。 第三章 营业运输与运输服务 第十九条 县级以上人民政府交通行政管理部门应当根据国家产业政策和社会运力、运量及船舶结构的实际，引导发展优质、节能的船舶投入营运;对耗能高、速度慢、技术性能差的船舶应当逐步淘汰。 第二十条 申请从事营业性水路运输、水路运输服务、港口业务的单位和个人，必须具备国家规定的相应条件，分别取得水路运输、水路运输服务、港口业务经营许可证，并凭证向当地工商行政管理部门申请登记，领取营业执照后，方可从事相关业务。 act according to the law, establish the correct achievements view, and strive to create a stand the inspection of practice, people and history of performance.
