含委托加工费及委托采购材料款），其余15%在项目主体框架封顶一个月内甲方向乙方结清。（2）、甲方支付货款均应汇入乙方指定的结算人的开户银行和账号；无乙方书面授权，甲方支付现金乙方不予认可。（3）、甲方指定，乙方指定。负责双方及时兑帐结帐。四、甲方的责任和义务：1、甲方应对交货验收以后的混凝土质量负责，并严格按照施工进行振捣、收光、抹平、养护，以及特殊情况下的保温、防风措施等，否则，因养护不当所引起的混凝土质量问，乙方不承担任何责任。2、甲方要求乙方提供预拌混凝土前，必须提前24小时以书面的形式提供预拌混凝土供应及技术要求，包括供应时间及混凝土等级、坍落度、数量、浇捣部位（特殊要求提前48小时）等，以便乙方备料及进行必要的试验。3、甲方必须为原料进出场运输车辆提供顺畅、安全的现场道路和卸货条件。并派专人对运输车辆进入施工现场进行调度指挥。4、由于甲方施工组织、浇筑技术和外部保障条件等原因（如路况差、停电、外部人为干扰施工），造成浇筑时间超过1.5小时未能在GB14902—2003《预拌混凝土》标准要求期限内浇筑完毕，所导致的混凝土质量下降，混凝土报废及人工损失均由甲方承担。5、甲方应负责混凝土泵送列管安装、固定、拆卸、清洗和保养工作。6、甲方无偿提供“明大王府”临界“蜀景首席”的空地给乙方，用于乙方为甲方、“蜀景首席”自拌砼。使用时间切至2015年12月底。五、乙方责任和义务：1、保证质量：乙方应按国家标准的技术要求生产预拌混凝土，并对交货检验之前的预拌混凝土质量负责。2、预拌混凝土配合比由乙方按GB14902—2003《预拌混凝土》国家标准的合格要求进行。3、乙方应按预拌混凝土技术规范和有关规定组织生产，按批量随机取样，制作出厂检验试块并提供给甲方。4、保证进度：统筹协调甲方需砼与“蜀景首席”项目用砼的进度，平等安排。乙方发货单要准确填写混凝土等级、数量、浇筑部位和签发日期，保证施工进度和工程连续浇筑需要。5、保证数量：乙方必须保证所发混凝土数量与发货单一致，约定按每方C30混凝土2400KG。保证误差不得超过2%6、乙方若因紧急事由，不能满足甲方需求时，应尽快通知甲方，同时应采取补救措施尽最大努力满足甲方施工要求。7、在商品混凝土浇筑前后，甲方有权要求乙方提供混凝土相关资料，乙方应及时提供。8、乙方在施工现场服从甲方的统一指挥和管理。9、乙方对施工现场人员进行工伤保险投保。六、安全责任：乙方在生产过程中必须对工人进行安全教育，严格按安全生产要求进行生产，保证不发生安全事故，并对安全事故负责。七、违约责任：1、乙方原因没保证混凝土质量给甲方造成直接损失由乙方全额赔偿。2、乙方承担未按时供货给对方造成直接损失。3、甲方如未及时结付给乙方合同款，则每天按应付款的千分之二向乙方支付违约损失。4、本合同生效后，甲乙双方都必须认真履约，不得随意变更或解除。如因一方原因而造成合同的终止，违约方应承担违约责任，并向对方支付本合同总价款5%违约金。5、甲方不按合同约定支付货款，乙方有权中止并解除合同，且保留在甲方足额支付混凝土款后继续履行合同的权力。6、如有恶意违约则违约方除按以上条款赔偿对方违约金外还需承担因违约给对方造成的间接损失。八、合同争议解决方式：任何与本合同有关或因履行本合同而产生的争议，应由双方协商解决，协商不成时，提交通江县仲裁委员会或向通江县人民法院提起诉讼；在诉讼或仲裁期间，本合同仍须履行。九、其他约定事项：1、本合同自双方签字盖章之日起生效，货款结清后自行失效。2、甲乙双方为履行合同而往来的函件及书面资料、单据等均视为与本合同具有同等法律效力。3、本合同一式四份，甲乙双方各执二份。4、未尽事宜双方另行协商。甲方：（章）乙方：法定代表人：法定代表人：委托代理人：委托代理人：电话：电话：传真：传真：开户银行：开户银行：账号：账号：合同签订日期：年月日附：委托加工混凝土价格表委托加工混凝土价格表单价：元/立方强度等级代采购材料加工费共计备注以下价格均不含发票C3036560425C3538560445C4040560465C4542560485C5045560515内容总结（1）混凝土委托加工合同委托方:（以下简称甲方）受委托方：（以下简称乙方）根据《中华人民共和国合同法》、《中华人民共和国建筑法》和混凝土行业相关规定，甲方将“明大王府”项目所需的混凝土委托乙方加工生产
