商品房竣工验收备案表 《竣工验收备案表》虽是房地产商自己填写,但要得到有关部门同意备案,是需要向备案部门提供规划、公安消防、环保、城市建设档案管理、人防等部门出具的认可文件或者准许使用文件的,购房人可由此知道房地产商所交付的房屋是否符合原来规划的要求。购房人收房时一定要看到备案表的正本,并检查上面是否有备案部门同意备案的签署和公章。 竣工验收备案表 《建筑法》、《法》等法律都规定了建筑工程竣工经验收合格后,方可交付使用,这是国家强制性规范。依据有关规定,我国目前的房屋经过验收和验收合格的标志是取得《建筑工程竣工备案表》,因此,出卖人在交付房屋时,应向买受人出示竣工验收备案表原件,否则,买受人有权拒绝交接,由此产生的逾期交房责任由出卖人承担。 如果出卖人交付的商品住宅未能取得竣工验收备案表,其中不排除该商品房在建筑质量方面存在重大的缺陷,同时,竣工验收备案表直接关系到房产证的办理,一旦将来发现该房屋始终无法拿到竣工验收备案表,房产证则始终无法办理。 根据建设部制定的房屋建筑工程和市政基础设施工程竣工验收备案管理暂行办法及湖南省及长沙市的有关规定,竣工验收备案表通常包括以下内容:1、工程的基本情况,包括项目名称、地址、规划许可证号、施工许可证号、工程面积、开工时间、竣工时间、各单位(建设、勘察、设计、施工、监理、质量监督等单位)名称;2、勘察、设计、施工、监理单位意见;3、竣工验收备案文件清单,主要包括:(1)工程竣工验收报告,分5项,其主要内容为室内环境检测报告和勘察、设计、施工、工程验收等单位分别签署的质量合格文件及验收人员签署的竣工验收原始文件;(2)规划许可证和规划验收认可文件;(3)、工程质量监督注册登记表;(4)许可证或开工报告;(5)消防部门出具的建筑工程消防验收意见书;(6)建设工程档案预验收意见;(7)、工程质量保修书;(8)住宅质量保证书;(9)住宅使用说明书;(10)建设单位与施工单位双方已签署意见的竣工结算;(11)房屋建筑工程和市政基础设施的有关质量检测和功能性试验资料;(12)法规、规章规定必须提供的其他文件。 质量监督站在收到建设单位报送的竣工验收备案文件并验证齐全后,应当在工程竣工验收备案表上签署文件收讫,加盖备案专用章;对符合条件、证明文件齐全有效的,应当收到申请之日起15日内按程序办理竣工验收备案。这时,共计四页的竣工验收备案表才是一份完整的备案表。 另外,《竣工验收备案表》上的每一项都必须报主管部门备案,例如消防设施等。缺少任何一项,买受人不能接受。 需要注意的是,《竣工验收备案表》只是建设(开发商)、设计、施工、监理及有关建设行政机关各方,就完工的建筑物的施工是否符合相关法律法规和设计所作的验收报告,并不能证明该建筑物没有质量问题,如果该商品房确有质量问题,主管单位可以收回备案表,责令建设单位按要求进行整改,全部整改完毕后重新组织工程竣工验收。 同时,《商品房》是开发商与购房人签署的,开发商交付的房屋是否符合合同要求、是否具备交付条件,也需要购房人来验收确认。 一、 购房者收房步骤 购房者收到交房通知单后的收房步骤: 1.在规定的时间去物业部门查看资料,资料包括:A、房屋的《住宅质量保证书》;B、《住宅使用说明书》;C、《竣工验收备案表》;D、面积实测表;E、管线分布竣工图(水、强电、弱电、结构); 2.购房者会同物业验房,验房根据《商品房买卖合同》的约定和相关法规规范,验房范围包括房屋及附属设施质量、室内有害气体是否超标及小区环境等; 3.购房者就验收中存在的问题提出质询、改进意见或解决,物业予以认可签字; 4.开发商在一定期限内解决验房中存在的问题后,再次发出交房通知单; 5.购房者再次会同物业验房,没有问题,购房者领取住宅钥匙,签署《住宅钥匙收到书》和《入住交接单》,商品房交付完成。 二、商品房交付中的注意事项 1、购房者在查看房屋资料时,房屋的《住宅质量保证书》和《住宅使用说明书》原件是可带走的,管线分布竣工图有时也是附在《住宅使用说明书》中。购房者查看《竣工验收备案表》原件需仔细,《竣工验收备案表》是目前收楼环节中最应该注意的文件,按照有关规定,表上的每一项都必须报有关主管部门备案,缺少任何一项该楼盘都不能入住。 作者: 60.211.139.* 2006-5-2 16:13 回复此发言 -------------------------------------------------------------------------------- 3 回复:商品房竣工验收备案表 2.购房者在没有验收房屋之前,不能签署《住宅钥匙收到书》,领取住宅钥匙,办理入住手续。因为根据《关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》(下称商品房买卖司法解释)的规定,“交钥匙”就算房屋交付使用。因此领取住宅钥匙以后验房发现问题,开发商只承担房屋质量包修责任,而没有逾期交房的压力。 3.购房者不能以开发商逾期交房责任没有承担为由,拒绝接收房屋。在交房条件满足的情况下,只要开发商依约发出了交房通知,即使你没有按约前来接收房屋,也算开发商履行了交房义务。在开发商已经逾期交房且不存在免责事由的情况下,是否追究以及何时追究开发商违约责任完全是购房者自身的权利,除购房者明确表示放弃外,接收房屋本身并不意味着购房者放弃追究开发商违约责任。 4.商品房交付过程中,购房者验房的标准依据是《商品房买卖合同》和房屋建筑方面的法律及规范,因此《商品房买卖合同》中的约定就极为关键。 ItAAAASA Close to the desired solution was prepared, and then use the reference material (or another material standard) to determine its exact concentration.
