人民币银行结算账户管理办法AdministrativeRulesforRMBBankSettlementAccounts中国人民银行令[2003]第5号颁布日期：20030410　实施日期：20030901　颁布单位：中国人民银行　　Decree[2003]No.5ofthePeople'sBankofChina　　April10，2003　　ChapterIGeneralProvisions　　Article1Theserulesareformulatedaccordingtothe“LawofthePeople'sRepublicofChinaonthePeople'sBankofChina”andthe“CommercialBankingLawofthePeople'sRepublicofChina”soastoregulatetheopeninganduseandstrengthenmanagementofRMBbanksettlementaccounts（hereinafterreferredtoas“banksettlementaccounts”）andsafeguardeconomicandfinancialstability.　　Article2TheserulesareapplicabletobanksettlementaccountsopenedbydepositorswithbanksdomiciledinChina.　　“Depositors”hereinafterrefertogovernmentagencies，socialorganizations，militaryunits，enterprises，publicinstitutionsandotherorganizations（referredasInstitutionshereinafter），self-employedentitiesandnaturalpersonsthatmaintainsettlementaccountswithbanksinChina.　　Banksintheserulesrefertopolicybanks，commercialbanks（includingwhollyforeign-fundedbanks，Sino-foreignjoint-equitybanksandbranchesofforeignbanks），urbanandruralcreditcooperativesthatareapprovedbythePeople'sBankofChinatoengageinpaymentandsettlementbusinessinChina.　　BanksettlementaccountsintheserulesrefertoRMBdemanddepositaccountsopenedbybanksfordepositorstoeffectpaymentandsettlementoffunds.　　Article3Banksettlementaccountsmaybeclassifiedonthebasisofthenatureofdepositorsintobanksettlementaccountsforinstitutionsandbanksettlementaccountsforindividuals.　　（1）Abanksettlementaccountopenedbyadepositorinthenameofaninstitutionisabanksettlementaccountforinstitution.Basedontheiruses，banksettlementaccountsforinstitutionsmaybedividedintobasicdepositaccounts，generaldepositaccounts，specialdepositaccountsandtemporarydepositaccounts.　　Banksettlementaccountsopenedbyself-employedentitieswiththebrandoftheirproductsorthenameoftheownerappearedinthebusinesslicenseshallbemanagedasbanksettlementaccountsforinstitutions.　　（2）AbanksettlementaccountopenedbyanaturalpersondepositorwithhisorherIDisabanksettlementaccountforindividual.　　Bankingaccountsopenedbypostalsavingsinstitutionstoconductbankingcardbusinessshallbemanagedasbanksettlementaccountsforindividuals.　　Article4Adepositoropeningbanksettlementaccountsforinstitutionsmayonlykeeponebasicdepositaccountinbanks.　　Article5Depositorsshallopenbanksettlementaccountsintheplacewheretheyareregisteredorlocated，exceptforthoseallowedbytheserulestoopenbanksettlementaccountsoutsidetheirplacesofresidence（indifferentprovinces，citiesorcounties）。　　Article6Openingofbasicdepositaccounts，temporarydepositaccounts，oropeningofspecialdepositaccountsbybudgetunitsshallbesubjecttoreviewandapprovalofthePeople'sBankofChina.Withtheapproval，thebankthatistoholdtheaccountshallissuearegistrationcertificateofopeningofsuchanaccount.However，temporarydepositaccountsopenedbydepositorsforthepurposeofexaminationofregisteredcapitalrequirementcomplianceareexemptedfromsuchastipulation.　　Article7Depositorsmaymaketheirownchoicesofbankstoopenbanksettlementaccounts.Noinstitutionsorindividualsareallowedtocommanddepositorstoopenbanksettlementaccountswithdesignatedbanks，unlessstipulatedotherwisebylaws，administrativeregulationsorrulesoftheStateCouncil.　　Article8Theopeninganduseofbanksettlementaccountsshallbeconductedinaccordancewithlawsandadministrativeregulations.Itisnotallowedtousebanksettlementaccountstoevadetaxanddebtpayment，makeillegalencashmentorforothercriminalpurposes.　　Article9Banksshallensureconfidentialityofinformationaboutdepositors'banksettlementaccounts.Banksshallhavetherighttodeclineanyinquiresbyinstitutionsorindividualsondepositsandotherrelevantinformationonbanksettlementaccountsforinstitutions，unlessstipulatedotherwisebythelawsandadministrativeregulations.Banksshallalsohavetherighttodeclineanyinquiriesbyinstitutionsorindividualsondepositsandotherrelevantinformationonbanksettlementaccountsforindividuals，unlessstipulatedotherwisebythelawsandadministrativeregulations.　　Article10ThePeople'sBankofChinaisthesupervisoryauthorityofbanksettlementaccounts.　　ChapterIIOpeningofBankSettlementAccounts　　Article11Thebasicdepositaccountsarebanksettlementaccountsthatthedepositorsneedtoopentoconductday-to-daytransferandsettlementoffundsaswellasreceiptandpaymentofcash.Followingdepositorsareeligibletoopenbasicdepositaccounts：　　（1）Anenterprisethatisalegalentity.　　（2）Anenterprisethatisnotalegalentity.　　（3）Governmentagenciesandpublicinstitutions.　　（4）Militaryunits，armedpoliceanddetachmentonseparatemissionsthatareaboveregimentlevel.　　（5）Socialorganizations.　　（6）Non-enterpriseprivateorganizations.　　（7）Permanentofficeoutsideitsplaceofresidence.　　（8）ResidentofficesofinternationalorganizationsinChina.　　（9）Self-employedentities.　　（10）Communityagencies.　　（11）Subsidiariesofinstitutionsthatmaintainindependentaccounts.　　（12）Otherorganizations.　　Article12Generaldepositaccountsarebanksettlementaccountsopenedbyadepositorforborrowingorotherpaymentneedswithbanksotherthanthebankthatholdsthebasicdepositaccount.　　Article13Specialdepositaccountsarebanksettlementaccountsopenedbyadepositortoseparatelymanageanduseearmarkedfundsinaccordancewithlaws，administrativerulesorregulations.Depositorsmayapplyforopeningofspecialdepositaccountsforthemanagementanduseoffollowingtypeoffunds：　　（1）Fundsforcapitalconstruction.　　（2）Fundsfortechnologyupgrading.　　（3）Extrabudgetaryfunds.　　（4）Fundsforprocurementofgrain，cottonandedibleoil.　　（5）Settlementfundsforsecuritiestransactions.　　（6）Marginfundsforfuturestrading.　　（7）Trustfunds.　　（8）Interbankdepositsoffinancialinstitutions.　　（9）Fundsforpolicyencouragedrealestatedevelopment.　　（10）Depositreservesforbankingcardsofenterprises.　　（11）Housingprovidentfunds.　　（12）Socialsecurityfunds.　　（13）Surrenderedproceedsandfundsforbusinessspending.　　（14）OperationalfundsforofficesoftheParty，theYouthLeagueandtheTradeUnioninstitutions.　　（15）Otherfundsthatneedtobeseparatelymanagedandused.　　Surrenderedproceedsandfundsbusinessspendingrefertoincomeandexpensesofnon-financiallyindependentsubsidiariesdetachmentsaffiliatedwithorofthedepositorsthatownbasicdepositaccounts.　　Specialdepositaccountsopenedforsurrenderedproceedsandfundsforbusinessspendingshallusethenameoftheparentinstitution.　　Article14Temporarydepositaccountsarebanksettlementaccountsopenedbyadepositorfortemporaryneedandtobeusedinalimitedperiodoftime.Depositormayapplyforopeningoftemporarydepositaccountsonthefollowingoccasions：　　（1）Establishmentoftemporaryinstitutions.　　（2）Temporaryoperationsindifferentplaces.　　（3）Examinationofregisteredcapitalrequirementcompliance.　　Article15Banksettlementaccountsforindividualsaredepositaccountsopenedbynaturalpersonsforinvestment，consumptionandsettlementpurpose，whichmaybeusedtocarryoutpaymentandsettlementbusinesses.Adepositormayapplyforopeningofbanksettlementaccountsforindividualsonthefollowingoccasions：　　（1）Usingcreditpaymentinstrumentssuchaschecksandcreditcards.　　（2）Conductingsettlementbusinesssuchasremittance，regularcredit，regulardebitanddebitcardbusiness.　　Anaturalpersonmayeitherapplyforopeningofbanksettlementaccountsforindividualsaccordingtohisorherownneeds，orselectanexistingsavingaccountasabanksettlementaccountforindividualsafterapplyingtotheaccount-holdingbankandgetitspermission.　　Article16Adepositormayopenbanksettlementaccountsoutsideitsplaceofresidenceonanyofthefollowingoccasions：　　（1）Placesofbusinessregistrationandoperationareindifferentadministrativeareas（differentprovinces，cities，counties），whichentailstheneedofopeningofbasicdepositaccounts.　　（2）Borrowingfromotherplacesorconductingothersettlement，whichneedtoopengeneraldepositaccounts.　　（3）Adepositorneedstoopenspecialdepositaccountsforsurrenderedproceedsorbusinessspendingofitsnon-financiallyindependentsubsidiariesordetachments.　　（4）Conductingtemporarybusinessoperationoutsideitsplaceofresidencethatneedtoopentemporarydepositaccounts.　　（5）Anaturalpersonthatneedstoopenbanksettlementaccountsforindividualusedoutsideitsplaceofresidence.　　Article17Whenapplyingforopeningbasicdepositaccounts，adepositorshallproducedocumentsaccordingtothefollowingrules：　　（1）Ifthedepositorisanenterprisethatisalegalentity，itshallpresenttheoriginalcopyofthebusinesslicenseforalegalentity.　　（2）Ifthedepositorisanenterprisethatisnotalegalentity，itshallpresenttheoriginalcopyofthebusinesslicenseforanenterprise.　　（3）Governmentagenciesandpublicinstitutionsthatareincludedinthebudgetprocessshallproduceapprovallettersorcertificatesofregistrationissuedbythepersonneldepartmentorstaffingquotacommissionofthegovernment，andpermissionissuedbyfiscalagencies.Publicinstitutionsthatarenotincludedinthebudgetprocessshallproduceapprovallettersandcertificatesofregistrationissuedbythepersonneldepartmentorstaffingquotacommissionofthegovernment.　　（4）Militaryunits，armedpoliceunitsatoraboveregimentallevelanddetachmentsonseparatemissionsshallpresentcertificatesofaccountholdingbythetreasurydepartmentsinunitsthatareabovearmylevelorinheadquartersofthearmedpolice.　　（5）Socialorganizationsshallproducetheirregistrationcertificates，whilereligiousorganizationsshallproduceapprovallettersorcertificatesissuedbyreligiousaffairsadministrationauthoritiesasanaddition.　　（6）Privatenon-enterpriseorganizationsshallproduceregistrationcertificatesforprivatenon-enterpriseorganizations.　　（7）Residentofficesoutsidetheirplacesofresidenceshallproduceapprovallettersissuedbythegovernmentofwheretheyarelocated.　　（8）ResidentofficesinChinaofinternationalorganizationsshallproduceapprovallettersorcertificatesissuedbyrelevantChineseauthorities；representativeofficesoroperationalbranchesofforeigncompaniesshallproduceregistrationcertificatesissuedbytheChineseregistrationagencies.　　（9）Self-employedentitiesshallproduceoriginalcopiesoftheirbusinesslicenses.　　（10）Communityagenciesshallproduceapprovallettersandcertificatesissuedbyrelevantauthorities.　　（11）Financiallyindependentsubsidiariesshallproduceregistrationcertificatesforopeningofbasicdepositaccountsandapprovallettersissuedtoentitiestowhichtheyareaffiliated.　　（12）Otherorganizationsshallproduceapprovallettersorcertificatesissuedbyrelevantauthorities.　　DepositorsinthisArticlethataretaxpayersandengagedinproductiveandcommercialactivitiesshall，inaddition，producetaxregistrationcertificatesissuedbythetaxationauthority.　　Article18Whenapplyingforopeninggeneraldepositaccounts，adepositorshallproducerelevantdocumentsaccordingtothefollowingrequirements，inadditiontothedocumentsrequiredforopeningbasicdepositaccountsandtheregistrationcertificateofopeningbasicdepositaccounts：　　（1）Ifinneedofborrowingfrombanks，thedepositorshallproduceborrowingcontracts.　　（2）Ifforthepurposeofconductingothersettlement，thedepositorshallproducerelevantdocuments.　　Article19Whenapplyingforopeningspecialdepositaccounts，adepositorshallproducerelevantdocumentsaccordingtothefollowingrequirements，inadditiontothedocumentsrequiredforopeningbasicdepositaccountsandtheregistrationcertificateofopeningbasicdepositaccounts：　　（1）Asfordepositingfundsofcapitalconstruction，technologyupgrading，policyencouragedrealestatedevelopment，housingprovidentfundsandsocialsecurityfunds，thedepositorshallproduceapprovaldocumentsofrelevantauthorities.　　（2）Asfordepositingextrabudgetaryfunds，thedepositorshallproduceapprovaloffiscalagencies.　　（3）Asfordepositingfundsforprocurementofgrain，cottonandedibleoil，thedepositorshallproduceapprovalofrelevantauthorities.　　（4）Asfordepositingreservefundsofinstitutionsforbankingcardtransactions，thedepositorshallproducerelevantdocumentsaccordingtotherulesonbankingcardtransactionsapprovedbythePeople'sBankofChina.　　（5）Asfordepositingsettlementfundsforsecuritiestransactions，thedepositorshallproducecertificatesissuedbysecuritiesfirmsorthesecuritiessupervisoryauthority.　　（6）Asfordepositingmarginfundsforfuturestrading，thedepositorshallproducecertificatesissuedbyfuturesfirmsorthefuturessupervisoryauthority.　　（7）Asforinterbankdepositsoffinancialinstitutions，thedepositorshallproducerelevantcertificates.　　（8）Asfordepositingsurrenderedproceedsandfundsforbusinessspending，thedepositorshallproducerelevantcertificatesofthedepositorsholdingbasicdepositaccounts.　　（9）AsfordepositingoperationalfundsforofficesoftheParty，theYouthLeagueandtheTradeUnionininstitutions，thedepositorshallproduceapprovaldocumentsorcertificatesissuedbytheseinstitutionsorrelevantauthorities.　　（10）Asfordepositingotherfundsrequiredtobemanagedorusedseparately，relevantcopiesoflawsandregulationsorrelevantdocumentsofgovernmentshallbeproduced.　　Article20SpecialRMBaccountandRMBfundsettlementaccountsopenedbyqualifiedforeigninstitutionalinvestors（QFII）fortheconvenienceofdomesticsecuritiesinvestmentshallbemanagedasspecialdepositaccounts.AQFIIshallproduceapprovalissuedbytheStateAdministrationofForeignExchangeforopeningspecialRMBaccount，andinthecaseofopeningRMBfundsettlementaccount，thebusinesslicenseforsecuritiesinvestmentissuedbythesecuritiesauthorityisrequired.　　Article21Whenapplyingforopeningtemporarydepositaccounts，adepositorshallproducerelevantdocumentstobanksaccordingtothefollowingrules：　　（1）Asfortemporaryinstitutions，theyshallproduceapprovalfortheirestablishmentsissuedbyrelevantauthoritiesinresidenceplace.　　（2）Asforconstructionorequipmentinstallationenterprisesoperatingoutsidetheiroriginalregistrationlocation，theyshallproduceoriginalcopiesoftheirortheirparentinstitutions'businesslicenses，andpermissionissuedbylocalconstruction/equipmentinstallationauthoritiesorcontractsofconstruction/equipmentinstallation.　　（3）Asforinstitutionsengagedintemporaryoperationsoutsidetheiroriginalregistrationlocation，theyshallproduceoriginalcopiesoftheirbusinesslicensesandapprovalissuedbylocaladministrationbureausofindustrycommerce.　　（4）Asforfundsdepositedforregistrationandexaminationofcapitalrequirementcompliance，thedepositorshallproduceNoticeofAdvanceApprovalofEnterprises'Namesissuedbytheadministrativeauthoritiesofindustrycommerceorapprovalofotherrelevantauthorities.　　Depositorsthatfallintosection（2）and（3）shall，inaddition，producetheirregistrationcertificatesforopeningofbasicdepositaccounts.　　Article22Whenapplyingforopeningofbanksettlementaccountsforindividuals，depositorsshallproduceIDcardstobanksaccordingtothefollowingrules：　　（1）ResidentsofChinashallproduceIDcardsortemporaryIDcards.　　（2）MilitaryunitsservicemenshallproducetheirarmyIDcards.　　（3）ArmedPoliceshallproducetheirarmedpoliceIDcards.　　（4）ResidentsofHongKong，MacauandTaiwanshallproducevalidIDcardsissuedbythestateimmigration/emigrationauthorities.　　（5）Foreigncitizensshallproducepassports.　　（6）Othervalidcertificatesstipulatedbylaws，regulationsandrelevantstatedocuments.　　Whenopeningbanksettlementaccountsforindividuals，banksmayalsorequireapplicantstoproduceothervalidcertificatesaccordingly，includingcertificationofpermanentresidenceregistration（Hukou），drivinglicensesorpassports.　　Article23Whenadepositorneedstoopenbanksettlementaccountsforinstitutionsoutsidetheiroriginalregistrationlocation，relevantcertificatesshallbeprovidedaccordingtothefollowingrulesinadditiontotherelevantdocumentsrequiredtobesubmittedinArticle17，18，19，20oftheserules：　　（1）Depositorsthatareregisteredandoperatingoutsidetheiradministrativeplaces，whenopeningbasicdepositaccountsoutsidetheiroriginalregistrationlocation，shallproducecertificatesissuedbybranchoffice（s）ofthePeople'sBankofChinainwheretheyareregistered，whichprovethattheyhavenotopenedbasicdepositaccounts.　　（2）Depositorsthatborrowfromoutsidetheiroriginalregistrationlocation，whenopeninggeneraldepositaccountsoutsidetheirplacesofresidence，shallproduceborrowingcontractsprovingtheyhavegotloansfromthatlocation.　　（3）Depositorstoeffectproceedssurrenderandbusinessspendingoutsidetheiroriginalregistrationlocationduetooperationalneeds，whenopeningspecialdepositaccountsinthatlocation，shallproducerelevantcertificatesoftheirparentinstitutions.　　DepositorsthatfallintoSection（2），（3）ofthisArticleshall，inaddition，producetheirregistrationcertificatesofopeningofbasicdepositaccounts.　　DepositorsthatneedtoopenbanksettlementaccountsforindividualsoutsidetheiroriginalregistrationlocationshallproducecertificatesrequiredbyArticle21oftheserules.　　Article24Titlesthatinstitutionsusetoopenbanksettlementaccountsshallbeconsistentwiththosetheyprovideintheircertificatedocumentsforapplicationforopeningofaccounts.Aself-employedentitywithabrandnameshallensureconsistenceofthetitleofitsbanksettlementaccountandthebrandnamerecordedinitsbusinesslicense.Titlesofbanksettlementaccountsopenedbyself-employedentitiesthathavenobrandnameshallcomprisecharactersof“Self-employedEntities”and“names”oftheownersrecordedintheirbusinesslicenses.TitlesofbanksettlementaccountsopenedbynaturalpersonsshallbeconsistentwithnamesinthevalidIDcertificatesprovided.　　Article25Whenabankopensageneraldepositaccount，anspecialdepositaccountoratemporarydepositaccountforadepositor，itshallinformthebankthatholdsthebasicdepositaccountforthatdepositorwithin3workingdaysaftertheopeningofsuchaccounts.　　Article26Applicationsfortheopeningofbanksettlementaccountsforinstitutionsmaybefiledbythelegalpersonorheadoftheapplyinginstitution，orotherpeopleauthorizedbythatinstitution.　　Ifitisthelegalentityorheadoftheinstitutionthatfilestheapplication，inadditiontorequiredcertificates，heorshestillneedstoproducehisorherIDcard.Inthecaseofotherpeopleauthorizedbytheinstitution，inadditiontotherequiredcertificates，heorshestillneedstoproduceauthorizationissuedbyandtheIDcardofthelegalentityorheadofthatinstitution，aswellashisorherownIDcard.　　Article27Whenapplyingforopeningofbanksettlementaccount，adepositorshallfilltheapplicationformforopeningofsuchaccount.TheapplicationformistorecordrelevantinformationrequiredbythePeople'sBankofChina.　　Article28Banksshallcarefullyverifytheauthenticity，integrityandregulatorycomplianceofcertificateandfilled-ininformationintheapplicationform.　　Whentheapplicationformisfilledcompletelyandmeetstherequirementsforopeningabasicdepositaccount，atemporarydepositaccountoranspecialdepositaccountofabudgetunit，thebankshallsendtothelocalbranchofficeofthePeople'sbankofChinathefilledapplicationform，therequiredcertificatesandreviewconclusionofthebankandgoonwiththeopeningaccountprocessafterbeingapprovedbythelocalbranchofficeofthePeople'sBankofChina.Astoapplicationsthatmeettherequirementsforopeninggeneraldepositaccounts，otherspecialdepositaccountsorbanksettlementaccountsforindividuals，banksshallcarryouttheopeningaccountprocessrightawayandfilethecasewiththelocalbranchofficeofthePeople'sBankofChinawithinfiveworkingdaysaftertheopeningofsuchaccounts.　　Article29ThePeople'sBankofChinashallreviewtheregulatorycomplianceofthedocumentssubmittedforopeningbasicdepositaccounts，temporarydepositaccountsandspecialdepositaccountsofbudgetunitswithintwoworkingdays.Itshallapprovethoseeligibleapplications，whilesignandreturnthoseineligibleapplicationformsalongwiththesubmittedcertificatesbacktothebank.　　Article30Whenopeningabanksettlementaccountforadepositor，thebankshallsignanagreementwiththedepositoronthemanagementofthatbanksettlementaccount，definingrightsandobligationsofeitherparty.Itshallalsokeepcardsthatcontainthestamporsignatureofthedepositorandkeepfilesoftheoriginalcopiesorduplicatesofthestamporsignatureandrequiredcertificates.　　Article31Registrationcertificatesofopeningaccountsarethevalidproofcontaininginformationonbanksettlementaccountsforinstitutions.Depositorsshallusethesecertificatesinaccordancewiththeserulesandkeeptheminsafeplace.　　Article32Whenopeninggeneraldepositaccounts，specialdepositaccountsortemporarydepositaccountsfordepositors，banksshallrecordontheregistrationcertificatesofbasicdepositaccountsnamesoftheaccounts，numbersoftheaccounts，natureoftheaccounts，bankstoholdtheaccountsandtheopeningdateoftheaccountsandstamponit.Temporarydepositaccountsthatareopenedbytemporaryinstitutionsorinneedofregistrationandexaminationofcapitalrequirementcomplianceareexemptedfromthisrequirement.　　ChapterIIIUseofBankSettlementAccounts　　Article33Basicdepositaccountistheprincipalaccountforadepositor.Fundsreceiptandpaymentindepositors'day-to-dayoperations，aswellaswithdrawalofsalary，bonusorcash，shallallbeconductedthroughthisaccount.　　Article34Generaldepositaccountistobeusedfordepositingborrowingproceeds，repayingdebtandothersettlements.Suchanaccountmaybeusedtosurrendercash，butisproh
