专业离婚律师 离婚后财产纠纷案例分析 离婚后财产纠纷案例分析 【案由】离婚后财产纠纷 【案情简介】 原告:房爱霞 被告:黄涛 一九八九年～原、被告登记结婚。同年十二月二十三日生育一女孩黄文静。二00二年四月一日～原、被告因生气到民政部门办理了离婚登记～领取了离婚证～离婚证上内容栏中载明“婚生女黄文静～由男方抚养～女方不拿抚养费,位于泰安路274号上下八间楼房～一个院子归男方所有～婚前财产各自归自己所有。” 离婚后～被告与她人结婚～原告感到与被告复婚无望～遂以协议离婚时财产分割不公为由向法院起诉～请求分割共同财产楼房八间及冰箱、电视机和VCD等。原告要求分割的八间楼房及院落～系一九九六年由原、被告与被告父母共同出资6.5万元购买。被告父母与原、被告离婚前一直共同居住生活。 婚生女黄文静现在初中读书～由被告抚养。 原告现暂住其娘家～无住所。 【裁判】 法院认为～原告诉称的主要财产八间楼房及院落～系原、被告及被告父母共同出资65000元购买～且原、被告与被告父母一直共同居住生活～该房产应为家庭共同财产～coupling Centre shall be checked, the second poured concrete strength of more than 70%.
