罗马法契约自由思想的形成及对后世法律的影响 罗马法契约自由思想的形成及对后世法律的影响 马俊驹 清华大学法学院 教授 , 陈本寒 武汉大学 法学院 本文认为，契约自由思想是随着罗马万民法诺成契约的出现而产生的。它是罗马共和国末期政治、经济发展和罗马人固有的市民法观念相结合的产物，其中罗马简单商品经济的高度发展对契约自由思想的形成起了决定性的作用。罗马万民法关于契约自由思想阐述，是契约法史上一次质的飞跃，后世大陆法国家民法典关于契约自由原则的规定，都不过是对罗马法契约自由思想的继受和发展。只是由于所处的时代不同，为了适应不同时期经济发展的需要，大陆法国家在继受这一思想的同时，也给这一思想打上了深深的时代烙印。 契约自由原则是资产阶级民法的三大基石之一，是当代契约法的核心和灵魂。这一原则在立法上得以确认，首创于1804年的《法国民法典》，其理论渊源却可追溯到罗马法。确切一点说，契约自由思想早在罗马古典法时期(约公元前3世纪至公元2世纪)就已形成，并在公元6世纪东罗马皇帝查士丁尼编纂的《国法大全》中得到了进一步阐述。作为《国法大全》重要组成部分的《法学阶梯》中，有关诺成契约(Contractus consensu)的规定已基本包含了现代契约自由的思想，即契约是当事人合意的产物，当事人间订立的契约具有法律效center pin checks and anchoring the inner cylinder.
