After the strong aftershock in Algeria, officials are asking people to stay calm and to avoid unsafe buildings. 別驚慌!一切都在掌控中。 “_______(82)_____________! _________(83)________________.” 84. 要不是你的警告,我早就犯下嚴重的錯誤。 If ____________________________, I would have made a serious mistake. 85. 這位遭到綁票的小男孩很幸運地能夠安然無恙重回父 母懷抱。 Fortunately, the kidnapped boy could return _________________________________. 高二Key 15 1-10 BCABD CDBAB 11-20 BCDCD ACDCA 21-30 DCACB DABDB 51-60 DBBDA CBADC 31-40 41-50 DCABC ABDDCACADA CBBDA 61. luxury 62. volunteered 63. emergencies 66. hazardous 67. emerged 68. logical 71-76 DFAEBC 82. 64. evidenc(转载于:www.XltkWJ.Com 小 龙 文档 网:两岸服贸协议对台利弊考,英文)e 65. distribute 69. ensure 70. deleted 篇二:两岸服茂协议为什么难通过 两岸“服贸协议”在台湾为什么难通过 去年6月21日,在上海举行的第九次两会领导人会谈期 间,海协会会长陈德铭与海基会董事长林中森签署了《海峡 两岸服务贸易协议》,这是两岸经贸正常化、自由化的又一 个非常重要的里程碑。本来这是一份互利双赢的协议,但由 于民进党的阻挠,8个月过去,这份协议仍迟迟不能审查通 过。服贸协议不能生效实施,既不利于深化扩大两岸经济合 作,更不利于台湾经济发展,受损害最大的则是台湾业界和 民众。何谓“服贸协议”,为什么在岛内一直不能通过,笔者 在《人民日报》上读到记者吴亚明的文章《“服贸”不过,台 湾难过》(《 人民日报 》2014年2月27日),不妨摘编如下。 为了帮助阅读,笔者对文章稍作调整,文字上有一些删减。 16 我想,读完这篇文章,对我们做对台工作的同仁会有所帮助。 “服贸”到底好在哪里, 两岸服务贸易协议在台湾被简称为“服贸”。“服贸”到底是一份什么样的协议, 通俗地来说,就是一份相互开放服务业市场的协议,我允许你到我的地盘上来做某些生意,你也允许我到你的地盘上做某些生意。其中,大陆对台开放共80条,台湾对大陆开放共64条,双方市场开放涉及商业、通讯、建筑、分销、环境、健康和社会、旅游、金融等服务行业。协议对两岸服务贸易市场的开放涉及了WTO《服务贸易总协定》12个服务部门中的11个。其中大陆方面出价均 高于对WTO的承诺水平,一次性出价涵盖的行业类别之多、开放力度之大,在大陆已签署的类似协议中前所未有。如在银行、保险方面,大陆允许台湾的银行在福建设立异地支行,允许台湾的银行在大陆发起设立村镇银行,积极支持符合资格的台湾保险业者经营交通事故责任强制保险业务。对于台湾业者多年期盼的在大陆设立证券、基金、期货公司,也予以了大幅开放。与此同时,台湾方面也对大陆服务业作出了一些开放,如已在台湾设有分行的大陆的银行符合条件者可申请增设分行,大陆的银联公司也可申请赴台设立分支机构。此外,陆资企业可望赴台开旅馆、餐厅,经营印刷、美容美发业,大陆业者也可以在台设立殡仪馆及火化场。 17 “服贸”到底好在哪里,商务部台港澳司负责人认为,两岸服务贸易协议实施,有助于加速两岸服务业融合、互补,共同提升两岸服务业的国际竞争力。在台湾,2012年服务业占其GDP的比重约72%,就业人口比重也长期保持近60%,是台湾经济增长的核心动力。在大陆,2012年服务业占GDP的比重约45%,“十二五”规划已将推动服务业大发展作为产业结构优化升级的战略重点,服务业发展空间广阔。“服贸”生效实施后,双方将在100多个服务行业相互开放市场,大陆拥有广阔的市场资源,台湾拥有先进的服务管理水平,两岸服务业的相互开放有利于优势互补、共享商机,共同提升国际竞争力,是一件互利双赢的好事。台湾《中国时报》刊文认为,对于服务业占经济总量约七成的台湾而言,有了服贸协议,台商进军大陆将“如虎添翼”。 “服贸”到底卡在哪里, 本来这是一份互利双赢的协议,但由于岛内的极端势力,以及民进党出于政 治目的,将服贸协议污名化,谎称如果台湾开放这些市场,将使得岛内相关产业很快被大陆业者吞并,而且还声称大陆劳工将大举入台,抢夺台湾人的饭碗,结果引起不明真相业者和民众的恐慌,社会上开始弥漫起一股反“服贸”的情绪。 那么,“服贸”协议真的会对台湾服务业带来强烈冲击吗,台湾业者最有发言权。美妆业者宋文端示,与大陆业者相较, 18 台湾美发业仍存在服务的软实力,没什么好担心的。餐饮业者黄老板更自豪地表示,从踏进餐饮业做学徒开始,已有超过40年资历,对自己手艺很有信心,不仅台湾人爱吃,连大陆客也捧场,曾有大陆艺文界人士称赞其手艺,比起大陆口味多了一分细腻。衣博士专业洗衣联盟总经理则认为,服贸协议有助于衣博士到大陆发展,靠专业与精致服务扩大市场规模。 海协会常务副会长郑立中介绍说,其实服贸协议未雨绸缪,考虑到了这些情况。为避免协议在执行中对一方服务部门造成实质性负面影响,针对部分台湾民众对协议冲击岛内服务业市场的担忧,协议专门设置“紧急情况的磋商”条款。据此,受影响一方可随时要求与另一方进行磋商,及时寻求办法加以解决。 从程序上讲,依据台湾“两岸人民关系条例”,“服贸”因为并未涉及“法律修正”,亦无须另以“法律”定之,签署之后只要经“行政院”核定,送“立法院”备查。而“立法院”需要在3个月内完成备查,如果在3个月之内没有完成备查,就视为通过。之后,“行政院”就可以宣布服贸协议启动生效。但在少数势力的胁迫下,国民党选择了妥协,经过所谓的“朝野协商”,双方达成了两个共识。一、“服贸”应经“立法院”逐条审查、表决,“服贸”承诺表应逐项审查、表决,不得予以全案包裹表决,非经“立法院”实质审查通过,不得启动生效 19 条款。二、需先于“内政委员会”召开 16场公听会。但是,8个月过去,在民进党等以消极方式拖延安排议程之下,迄今只办理了15场。也就是说,时至如今,服贸协议还被深锁在“立法院”的抽屉里,公听会还没有搞完,连安排审查的资格都还没有。 “服贸”到底啥时生效, 自从两岸服务贸易协议签署,岛内有识之士就呼吁台湾当局尽速通过审查,让“服贸”早日生效,早日造福民众,提升台湾经济竞争力。 全国台湾同胞投资企业联谊会会长郭山辉,不久前带着30多位大陆各地台协会长返台,联合召开”支持服务贸易,台湾经济加油”记者会,表达对两岸服贸协议的支持。他们还向台“立法院”递交了大陆165名台协会长呼吁服贸协议尽速通过的联署书。郭山辉坦言,服贸协议至今尚未排入正式审查议程,不少台商都感到忧心。目前公听会尚未开完,接下来可能还要进行逐条审查,如此一来势必要耗费更多时间,若一再拖延,对台商来说绝对不是好事,原先可能取得的先机也将消失。 台湾商业总会、工业总会、中小企业总会等六大工商团体负责人也多次约见台“立法院长”王金平,盼速审海峡两岸服务贸易协议。台湾商业总会理事长张平沼表示,两岸“服贸”若持续延宕,甚至可能影响两岸货品贸易协议的谈判,使台 20 湾地区在面对日本、韩国的竞争时,竞争力大受影响。因此,希望“立法院”尽速处理服贸协议。 2月21日,台湾“立法院”新会期开议,台湾“行政院长”江宜桦在“立法院”作并备质询时表示,时间是台湾竞争力的关键,两岸服务贸易协议迟迟未能通 过审查,不但将使台湾优势产业坐失商机,也伤害全球竞争力,希望“立委”给予大力支持。同日,台湾《中国时报》刊发社论,认为台“行政院”应该根据岛内有关规定,径行宣布两岸服贸协议生效。然而,就在当日,民进党“立院”党团要求审查“服贸”前应先通过两岸“缔结协议处理条例”,落实所谓“立法院”监督、审议和修正两岸协议内容的权力,国民党“立法院”党团则提出“立法院”监督两岸事务的“4阶段流程”,切实建立行政和“立法”整体沟通机制,达到实质监督效果。一时之间,“山雨欲来风满楼”。 台湾服贸协议为何掀起轩然大波 篇三:海峡两岸服贸协议 海峡两岸服务贸易协议 为加强海峡两岸经贸关系,促进服务贸易自由化,依据《海峡两岸经济合作框架协议》及世界贸易组织《服务贸易总协定》,海峡两岸关系协会与财团法人海峡交流基金会经平等协商,达成协议如下: 第一章总则 21 第一条目标 本协议致力于: 一、逐步减少或消除双方之间涵盖众多部门的服务贸易限制性措施,促进双方服务贸易进一步自由化及便利化; 二、继续扩展服务贸易的广度和深度; 三、增进双方在服务贸易领域的合作。 第二条定义 就本协议而言: 一、“服务贸易”指: (一)自一方内向另一方内提供服务; (二)在一方内向另一方的服务消费者提供服务; (三)一方服务提供者通过在另一方内的商业存在提供服务; (四)一方服务提供者通过在另一方内的自然人存在提供服务。 二、“服务部门”指: (一)对于一具体承诺,指一方承诺表中列明的该项服务的一个、多个或所有次部门; (二)在其他情况下,指该服务部门的全部,包括其所有的次部门。 三、“人”指自然人或法人。 四、“法人”指根据两岸任一方相关规定在该方设立的实 22 体。 五、“服务提供者”指两岸任一方提供服务的任何人。如该服务不是由法人直接提供,而是通过分支机构或代表处等其他形式的商业存在提供,则该服务提供者(即该法人)仍应通过该商业存在享有本协议所给予的待遇。此类待遇应扩大至提供该服务的存在方式,但不需扩大至该服务提供者位于提供服务的一方之外的任何其他部分。 六、“服务消费者”指接受或使用服务的任何人。 七、“措施”指两岸任一方的规定、规则、程序、决定或任何其他形式的措施。 八、“一方影响服务贸易的措施”包括关于下列事项的措施: (一)服务的购买、支付或使用; (二)与服务提供有关,且该方要求向公众普遍提供的服务的获得和使用; (三)另一方的人为在该方内提供服务的存在,包括商业存在。 九、“商业存在”指任何类型的商业或专业机构,包括以下列方式在一方内提供服务: (一)设立、收购或维持一法人,或 (二)设立或维持一分支机构或代表处。 第三条范围 23 一、本协议适用于双方影响服务贸易的措施。 二、本协议不适用于: (一)公共采购; (二)在一方内为行使公共部门职权时提供的服务; (三)一方提供的补贴或补助,或者附加于接受或持续接受这类补贴的任何条件。但如果前述补贴显著影响一方在本协议下所作具体承诺,另一方可请求磋商,以友好解决该问题。应另一方请求,一方应尽可能提供与本协议下所作具体承诺有关的补贴讯息; (四)两岸间航空运输安排,即《海峡两岸空运协议》与《海峡两岸空运补充协议》及其后续修正文件所涵盖的措施及内容; (五)与两岸间航空运输安排的行使直接有关的服务,但不包括《海峡两岸经济合作框架协议》及其后续协议项下的服务贸易市场开放承诺表所列措施; (六)双方有关海运协议的相关措施,但不包括《海峡两岸经济合作框架协议》及其后续协议项下的服务贸易市场开放承诺表所列措施; (七)双方同意的其他服务或措施。 三、世界贸易组织《服务贸易总协定》关于自然人流动的附件经必要调整后适用于本协议。 四、双方各级业务主管部门及其授权的机构应履行本协议 24 项下的义务和承诺。 第二章义务与规范 第四条公平待遇 一、一方对于列入其在世界贸易组织中所作服务贸易具体承诺减让表、《海峡两岸经济合作框架协议》附件四“服务贸易早期收获部门及开放措施”及本协议附件一“服务贸易具体承诺表”的服务部门,在遵守前述减让表、开放措施或承诺表所列任何条件和资格的前提下,就影响服务提供的所有措施而言,对另一方的服务和服务提供者所给予的待遇,不得低于其给予该一方同类服务和服务提供者的待遇。 二、本条第一款不适用于一方现有的不符措施及其修改,但该一方应逐步减少或消除该等不符措施,且对该等不符措施的任何修改或变更,不得增加对另一方服务和服务提供者的限制。 三、根据本条第一款所作的具体承诺不得解释为要求任 一方对于因相关的服务或服务提供者的非当地特性而产生的任何固有的竞争劣势作出补偿。 四、一方可对另一方的服务和服务提供者给予与该一方同类服务和服务提供者形式上相同或不同的待遇,以满足本条第一款要求。如此类形式上相同或不同的待遇改变竞争条件,且与另一方的同类服务或服务提供者相比有利于该一方的服务或服务提供者,则应被视为较为不利的待遇。 25 五、关于一方影响服务贸易的措施,除符合世界贸易组织《服务贸易总协定》第二条第二款规定的豁免外,该一方对另一方的服务和服务提供者所给予的待遇,不得低于该一方给予的普遍适用于其他任何世界贸易组织成员的同类服务和服务提供者的待遇。 六、本条第五款不适用于一方现有的不符措施及其修改,但该一方应逐步减少直至消除该等不符措施,且对该等不符措施的任何修改或变更,不得增加对另一方服务和服务提供者的限制。 第五条讯息公开与提供 一、一方应依其规定,及时公布或用其他方式使公众知悉普遍适用的或针对另一方与服务贸易有关的措施。 二、应另一方请求,一方应依其规定,及时就已公布并影响另一方服务提供者的措施的变化提供讯息。 三、一方不得要求另一方提供一经披露即妨碍执行相关 相关热词搜索:英文 利弊 两岸 对台 协议 海峡两岸空运协议英文 反服贸协议 26
